PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2003-38 <br />RESOLUTION APPROVING THE APPLICATION OF JIM HAMRA FOR <br />CONDITIONAL USE PERMIT APPROVAL, AS FILED UNDER CASE <br />PCUP-93 <br />WHEREAS, Jim Hamra has applied for conditional use permit approval to operate an <br />indoor volleyball training facility within an existing building located at <br />440 Boulder Court; and <br />WHEREAS, zoning for the property is I-G-40 (General Industrial) District; and <br />WHEREAS, at its duly noticed public hearing of September 10, 2003, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with <br />the objectives of the zoning ordinance and the purpose of the <br />district in which the site is located. <br />The proposed facility is an indoor training facility and all activities <br />associated with the use would be confined inside the building. The <br />proposed operation would not interfere with surrounding businesses' <br />ability to operate and would not generate any unusual demands on the <br />existing pazking for this industrial area or the surrounding properties. <br />The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />The proposed indoor volleyball training facility is not open to the public <br />and it is small in scale when compared to other recreation facilities in <br />town. Its operation would be confined inside the building and its weekday <br />practice contains a group of five people. The subject facility is <br />approximately 820 feet from the nearest residential property. Adequate <br />and safe ingress and egress into and out of the site, sufficient on-site <br />parking, indoor practice, and the lack of competitions or exhibition games <br />would make the proposed use suitable for the subject site. <br />
