BACKGROUND AND DISCUSSION <br /> The Spotorno Family Trust, AVS Ranch, LLC now propose a 22-single-family residential <br /> development in the area identified as the Spotorno Flat Area of the HVSP.1 This proposal <br /> is consistent with the development density set forth in the HVSP, analyzed in the HVSP <br /> EIR and the 2005-2025 Pleasanton General Plan EIR (General Plan EIR). Where there <br /> is a certified EIR for a specific plan, CEQA and its Guidelines can limit projects consistent <br /> with specific plans from further CEQA review under Government Code §65457 and Public <br /> Resources Code §21155.4. The requirements for both provisions are found in CEQA and <br /> its Guidelines §15182 and §15183. <br /> Hence, pursuant to Guidelines §§15182 and 15183, FCS will prepare an Initial Study, <br /> which will disclose the evidence and reasoning for determining the proposed project's <br /> consistency with the HVSP, the HVSP EIR, and eligibility for the 15182 and 15183 <br /> CEQA exemptions. To facilitate this review, FCS will utilize technical studies and <br /> analysis they had previously completed in 2018 for the larger, 39-lot project previously <br /> proposed by Tim Lewis Communities, within the same area of the Spotorno property, <br /> known as the Spotorno Flat. <br /> Staff has reviewed the FCS proposal with the applicant, who has accepted the proposal <br /> and will submit the required funds to cover the proposed costs.
