Resolution No. PC-2003-36 <br />Page 4 <br />Exhibit "C" <br />Conditions of Approval for <br />PCUP-89 <br />August 13, 2003 <br />Approval of this conditional use permit shall be contingent upon approval of the <br />PUD development plan modification, Case PUD-93-02-SM. <br />Weddings and similar types of ceremonies are allowed to take place in the patio <br />area by the east side of the event center. During these ceremonies, there may be <br />acoustical-only performers. Outdoor activities shall cease by 9:00 p.m. All other <br />events/performances shall take place inside the event center only, and shall <br />conclude by 11:00 p.m. During the event/ performance, the windows and <br />entrance/exit doors on the building sides facing the Ruby Hill homes shall remain <br />closed, but not locked, at all times. An automatic door closing mechanism shall <br />be provided on the doors between the patio and event center building. <br />3. For large events/performances taking place at the event center/barrel storage <br />building, which would exceed the parking capacity of the main parking lots <br />adjacent to the winery building, the owner/operator shall provide valet parking <br />and two valet stations located on the east and west sides of the main winery <br />building. If necessary, the project developer may configure the driveway aisles in <br />these locations to a one-way direction enabling these valet stations to handle two <br />or more parallel rows of waiting cars. At no time may guests be allowed to queue <br />onto Vineyard Avenue. <br />4. If guest traffic to/from the event center leads to congestion on Vineyard Avenue, <br />the City has the discretion to require the project developer post temporary traffic <br />control personnel to direct traffic. The costs associated with the traffic control <br />personnel shall be paid for by the project developer. <br />5. At no time shall balloons, banners, pennants, search lights, or other attention- <br />getting devices be utilized on the site. This prohibition would not apply to the <br />building and palm tree up-lighting. <br />6. In the event that nuisances are created through the operation of the event center, <br />either within the event center itself or by its patrons in its vicinity, including DUI <br />violations, the Planning Director may refer the conditional use permit to the <br />Planning Commission for review at a public hearing. If necessary, the Planning <br />Commission may add additional conditions of approval or may revoke the <br />conditional use permit. <br />7. If operation of this use results in conflicts pertaining to parking, noise, traffic, or <br />other impacts, at the discretion of the Planning Director, this conditional use <br />permit may be referred to the Planning Commission for subsequent review at a <br />
