Prior to the issuance of a building permit, the property owner or applicant shall <br />enter into an agreement with the City, approved by the City Attorney, which <br />guarantees that all landscaping and open space areas included in this project, <br />including the land between the property line and the sidewalk, will be maintained <br />at all times in a manner consistent with the approved landscape plan (as <br />conditioned) for this development. Said agreement shall run with the land for the <br />duration of the existence of the structures located on the subject property. <br />16. All proposed and required landscaping shall be irrigated. The site irrigation design <br />shall utilize low-volume drip, bubbler, or other water conserving irrigation systems <br />to maximize water conservation to the greatest extent possible. The irrigation <br />systems shall include a soil moisture, rain sensor, or other irrigation efficiency <br />device. The proposed type of irrigation efficiency device shall be shown on the <br />plans submitted for the issuance of building permits. <br />17. A final landscape plan and irrigation plan shall be submitted to and approved by <br />Planning Director as part of the building permit plan sets prior to issuance of a <br />building or on-site permit. Said landscape plan shall be consistent with the <br />approved landscape plan plus any conditions of approval, and shall be detailed in <br />terms of species, location, size, quantities, and spacing. The landscaping and <br />irrigation plans are subject to the review and approval of the Planning Director. <br />18. All trees used in landscaping shall be a minimum of 15 gallons in size and all <br />shrubs a minimum of 5 gallons. <br />19. Six-inch vertical concrete curbs shall be installed between all paved parking lot <br />areas and landscaped areas, with the exception of the curb cut areas for the <br />bioswales. <br />20. The project developer shall provide root control barriers and four-inch perforated <br />pipes for parking lot trees, street trees, and trees in planting areas less than ten feet <br />in width, as shown on Exhibit A. <br />21. Prior to occupancy, the landscape architect shall certify in writing to the Planning <br />Director that the landscaping has been installed in accordance with the approved <br />landscape and irrigation plans with respect to size, number and species of plants <br />and overall design concept. <br />
