If, based oni <br /> said investigation, the Health Officer concludes there <br /> is probable cause to believe that the dog is vicious he <br /> shall so certify in writing to the City Clerk. <br /> <br /> .13 Confinement of Dog <br /> If pursuant to 34-6.12, a dog is certified to the City ~ <br /> Cl~rk as being probably vicious, the Health Officer sha~l <br /> insure that the dog is confined either on the premisei~! <br /> , r e e <br /> with the cost of confinement therein deemed a part of <br /> the cost of abatement if such is eventually the order. <br /> Said confinement shall continue pending disposition of <br /> the hearing provided for in ~4-6.14. <br /> <br />§4-6.14 Scheduled Hearing <br /> The City Clerk shall upon receipt of a certification uneer <br /> §4-6.12 schedule a hearing before the Appeals Board <br /> created by Article 2, Chapter 3, Title II of the Ordinarce <br /> Code. The hearing date shall be no longer than 10 days <br /> from receipt by the City Clerk of the certification. <br /> City Clerk shall mail to the owner of the dog at least <br /> 5 days prior the date set for hearing a notice in form <br /> substantially as follows · <br /> <br /> T~NOTICE OF HEARING REGARDING VICIOUS DOG~ <br /> <br /> NOTICE IS HEREBY GIVEN that pursuant to the provisions ~f <br /> Chapter 3, Title IV of the Ordinance Code of the City <br /> Pleasanton, the Health Officer has certified your dog aS <br /> being probably vicious. <br /> <br /> FURTHER NOTICE IS HEREBY GIVEN that on <br /> the day of __, <br /> , 19 at the hour of <br /> o'clock P.M. , in ' <br /> , Pleasanton, Alameda County~ Califor ia, <br /> <br /> the Appeals Board together with such other oral and c - <br /> mentary evidence bearing upon the question of whether t~e <br /> dog herein is vicious. <br /> <br /> In the event the dog herein is found to be vicious he <br /> will be abated as a public nuisance and the cost~ if an~, <br /> of said abatement assessed against you. <br /> <br /> Dated: <br /> <br /> City Clerk" <br /> <br /> · ].5 Hearing <br /> At the hearing before the Appeals Board which may be co - <br /> tinued from time to time both oral and documentary evi-~ <br /> dence shall be taken and considered bearing upon the <br /> question of whether or not the dog in question is vicious, <br /> consistent with the provisions of ~4-6.12 hereof. <br /> <br /> .16 Findings: Public Nuisance <br /> If based upon the hearing the Appeals Board finds that ~he <br /> dog in question is vicious it shall so specify in writi g <br /> together with reasons therefor. Any dog found to be <br /> vicious is hereby deemed a public nuisance and shall be <br /> pursuant to the order of the Appeals Board, humanely <br /> destroyed by the Director, removed from the City or oth~r- <br /> wise abated. <br /> <br />~4-6.17 Cost of Abatement <br /> The cost of abatement herein shall be paid for the <br /> owner of the dog and shall become a lien against the <br /> property of the owner, if any, upon which the dog was <br /> kept and maintained until said assessment is paid. <br /> <br /> -2- <br /> <br /> <br />
