CITY COUNCIL 0F THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 638 <br /> <br /> AN ORDINANCE ADDING ARTICLE 7 TO CHAPTER 3 OF TITLE IV <br /> OF THE ORDINANCE CODE OP THE CITY OF PLEASANTON RELATING <br /> TO VICIOUS DOGS AND THE ABATEMENT THEREOF AS PUBLIC <br /> NUISANCES. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> I. <br /> <br /> Chapter 3 of Title IV of the Ordinance Code of the City of <br /> Pleasanton is hereby amended by adding thereto Article Y as follow~ <br /> <br /> "Article 7 <br /> Vicious Dogs and Abatement thereof <br /> <br /> ~4-6.10 Purpose and Intent <br /> There have been, are and will be in the future in the City <br /> of Pleasanton dogs which are vAcUous and which, as such <br /> constitute a public n isance w i h should b abated. T~e <br /> provmsmons of this Article are intended to provide a <br /> vehicle pursuant to which dogs found, following a hearing <br /> at which oral and documentary evidence is considered, to <br /> be a public nuisance may be removed from the City or <br /> otherwise abated. This Article is intended to supplement <br /> rather than supplant any other remedy available either <br /> under State law or City Ordinance. <br /> <br /> ~4-6.11 Vicious Do~ Defined <br /> A vicious dog shall' mean a dog with a propensity to bite <br /> human beings. In determining whether a dog is vicious <br /> the following factors shall be considered: <br /> <br /> 1. Whether and how many times the dog has bitten human <br /> beings. <br /> <br /> 2. Whether a biting or bitings have occurred while the <br /> dog was under the control or on the property of the <br /> owner thereof. <br /> <br /> 3 The severity of any bite or bitings. <br /> ' <br /> <br /> 4. The circumstances surrounding any bite or bitings <br /> including but not limited to whether the dog was <br /> provoked, whether the biting or bitings occurred <br /> during play with the animal and density of population <br /> in the area in which the dog is kept. <br /> <br /> 5. Such other circumstances and considerations deemed <br /> relevant to the question of whether or not the dog <br /> is vicious. <br /> <br />!~4-6 12 Investigation <br /> Any dog quarantined pursuant to ~4-5.21 of this Code for <br /> biting a human being shall be investigated by the Health <br /> Officer. In cases in which the owner of the dog refuses <br /> tO cooperate in the investigation the Health Officer may <br /> <br /> <br />
