(TRL); and (5) address possession of tobacco products by persons under age 21 by amending <br /> Municipal Code Chapter 9.32 and Title 18 <br /> Action recommended: Staff recommends City Council: (1) not incorporate minimum <br /> package sizes or prices in the City's tobacco regulations; and (2) <br /> introduce an ordinance to enact tobacco restrictions per <br /> Council's February 18, 2020 action, with enforcement of the <br /> prohibition on the sale of flavored tobacco and electronic <br /> smoking devices and related paraphernalia beginning 12 months <br /> from the ordinance's effective date (May 24, 2021) <br /> Action taken: Approved per staff recommendation, with modifications to: <br /> (1) ban sale of flavored tobacco city-wide; (2) ban sale of <br /> electronic smoking devices and related paraphernalia city-wide; <br /> (3) prohibit new tobacco sales within 1,000 feet of public schools, <br /> parks and recreation facilities; grandfather existing tobacco <br /> retailers and stores - with a modification that change in <br /> ownership ends grandfathering; (4) direct staff to bring back <br /> tobacco retailer licensing (TRL) as part of municipal code (not <br /> delegation to City Manager to developer program); (5) direct staff <br /> to bring back explanation of how persons under age 21 in <br /> possession of tobacco products will be referred to counseling; (6) <br /> adopt minimum package size and pricing per parameters listed in <br /> staff report (page 5) with modification about minimum price listed <br /> plus taxes and fees; and (7) effective date for enforcement of <br /> ban on flavored tobacco and electronic smoking devices as <br /> January 1, 2021 <br /> Vote: 5-0 <br /> Additional action <br /> taken: Direct staff to bring back information about potential exemption <br /> from flavored tobacco ban for loose flavored pipe tobacco and <br /> premium flavored cigars in coordination with City of Livermore <br /> Vote: 3-2 (Councilmembers Brown, Testa Noes) <br /> Actions of the City Council Page 2 of 2 May 13, 2020 <br /> of 9 March 11, 2020 <br />e of the <br /> two designs. Regarding massing, she is amenable to staff's recommendations and she <br /> inquired if there were other concepts or examples of similar five-story buildings with this many <br /> units as a comparison. <br /> Commissioner Balch stated he was amenable to the general massing referenced in Discussion <br /> Point 3 and mentioned that the option selected is the slightly better choice. <br /> Commissioner Ritter discussed the layout and positioning and to Commissioner Allen's point, <br /> agreed with her comments around the importance of traffic circulation; he further stated the <br /> massing is all-encompassing of that and requested additional articulation on the building <br /> design. <br /> Commissioner Brown expressed concern with the wrap-around building and the view from <br /> Stoneridge Mall Road. <br /> Planning Commission Minutes Page 7 of 9 March 11, 2020 <br />already <br /> approved and accounted for increased congestion.
