Resolution No. PC-2003-29 <br />Page 5 <br />EXHIBIT "B" <br />CONDITIONS OF APPROVAL <br />CASE PUD-17 <br />8272 Sassafras Court <br />July 9, 2003 <br />Planning <br />The proposed development shall conform substantially to the development plan and <br />design guidelines/development standards Exhibit A, dated "Received May 6, 2003", <br />on file with the Planning Department, except as modified by these conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning Director <br />if found to be in substantial conformance with the approved exhibits. <br />2. The development plan shall be of no further validity and the project developer shall <br />be required to submit the same or new development plan for City approval prior to <br />development of the site in the event that the project developer fails to record a final <br />parcel map within two (2) years of PUD approval. <br />3. The project shall be subject to all uses, development standards, and other related <br />requirements of PUD-89-17 and Vesting Tentative Tract Map 6563, except as <br />specifically modified by this approval. <br />4. The northwest lot line of Parcel 3 shall be revised to follow the toe of the adjacent <br />recent landslide as shown on "Exhibit -Staff prepared Modified Setback Area". The <br />PUD development plan site plan shall be modified to reflect this lot line revision and <br />marked with the landslide outlines and modified landslide setbacks. This modified <br />site plan shall be submitted for the review and approval of the City's geotechnical <br />peer reviewer. All costs associated with this peer review shall be paid for by the <br />developer prior to approval of the minor subdivision. <br />5. The PUD development plan shall be revised to show the revised building envelope/ <br />setbacks per this approval prior to the approval of the minor subdivision. <br />6. The design guidelines shall be modified to include the prohibition of the use of <br />second-story windows in the front of the future residence on proposed Parcel 1 that <br />would allow views from inside the house to the future home at 8243 Foundry Court. <br />Other windows, such as clerestory, obscured glass, etc., could be used as they would <br />not allow views from within the house towards the street <br />
