Box 520 <br /> Pleasanton, CA 94566-0802 <br /> EASEMENT AND MAINTENANCE AGREEMENT <br /> SUN MEADOWLARK ESTATES <br /> (Stormwater,Open Space and Landscape) <br /> THIS EASEMENT AND MAINTENANCE AGREEMENT SUN MEADOWLARK <br /> ESTATES ("Easement and Maintenance Agreement") is entered into this day of <br /> , 2020, by and between the City of Pleasanton ("Grantor") and Sun <br /> Meadowlark,LLC,a California limited liability company("Grantee"). <br /> RECITALS <br /> A. Grantor is the owner of the real property commonly known as the "Future <br /> Maintenance Agreement Area (Stormwater Treatment Facility Serving Tract 7813)," as shown on the <br /> map of Tract 7813 ("Map"), recorded on , 2020, as Series No. 2020- , in <br /> the Official Records of Alameda County ("County"), State of California ("Servient Tenement No. <br /> 1"). The Servient Tenement No. lis bounded on the North by Kingbird Court, on the West by Lot 1, <br /> as shown on the Map, on the South by lands owned by Grantor and on the East by Old Foothill Road <br /> and is further described in Exhibit "A" hereto. Grantor is also the owner of the real property that is <br /> adjacent to each of the Lots 1 through 8, inclusive, which is shown on the Map as "Landscape <br /> Maintenance Easement & Understory Fuels Management Easement and commonly referred to as the <br /> Landscape Buffer Area("Servient Tenement No.2"). <br /> B. By this Easement and Maintenance Agreement, Grantor intends to grant to Grantee <br /> easements over Servient Tenement No. 1 and Servient Tenement No. 2 necessary to enable Grantee to <br /> perform its maintenance obligations set forth in the Easement and Maintenance Agreement. <br /> C. Grantee is the owner of Lots 1 through 8, inclusive, as shown on the Map ("Project" <br /> or"Dominant Tenement"). <br /> D. Grantee has incorporated the Sun Meadowlark Estates Owners Association, its <br /> successors and assigns, a nonprofit mutual benefit corporation incorporated under the laws of the State <br /> of California ("Association") to which it intends to transfer all rights and duties under this Easement <br /> and Maintenance Agreement upon the close of escrow for the first Lot to be sold in the Project. From <br /> and after that point in time, the Association shall be solely responsible to perform all the maintenance <br /> 1 <br />
