PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2003-28 <br />RESOLUTION DENYING THE APPLICATION OF NORTHSTAR DEVELOPMENT <br />FOR VESTING TENTATIVE MAP APPROVAL, AS FILED UNDER CASE PTR-7399 <br />WHEREAS, Northstar Construction has applied for vesting tentative map approval consisting of: <br />(1) 19 single-family lots within the 13.2-acre Low Density area; (2) a 12.4-acre <br />Hillside Residential/Open Space lot (parcel A) containing the existing Chrisman <br />residence and associated accessory buildings; (3) three commonly-owned open <br />space lots (Parcels B, C, and D) containing about 4.7-acres; and (4) associated <br />streets, old Vineyard Avenue trail, and related infrastructure located at 1944 <br />Vineyard Avenue and a portion of 2200 Vineyard Avenue; and <br />WHEREAS, zoning for the property is Planned Unit Development - Low Density <br />Residential/Hillside Residential/Open Space District; and <br />WHEREAS, at its duly noticed public hearing of July 9, 2003, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, an Environmental Impact Report (EIR) was prepared and certified for the <br />Vineyard Avenue Specific Plan which includes this property; and <br />WHEREAS, the Planning Commission determined that the changes in grading, the retaining <br />walls, and the increase in excavation constituted a major change to the PUD; and <br />the required findings could not be made; and <br />WHEREAS, pursuant to Pleasanton Municipal Code Chapter 19.20 and California Government <br />Code Section 66474, the Planning Commission determined that the Vesting <br />Tentative Map for Tract 7399 did not conform to the conditions imposed by the <br />Planned Unit Development zoning approvals and that the property was not <br />suitable for the proposed subdivision, particularly related to the increased grading <br />and excavation and existence of the retaining wall. <br />
