Resolution No. PC-2003-19 <br />Page 3 <br />Exhibit "B", Final Conditions of Approval <br />Per Planning Commission (June 11, 2003) <br />PADR-729 (Residence of Greg and Nancy Crofton) <br />4757 Peaceful Lane <br />1. The building addition covered by this approval shall be constructed in substantial <br />conformance to the design plans, Exhibit "A", dated "Received June 5, 2003" on file with <br />the Planning Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning Director if <br />found to be in substantial conformance to the approved exhibits. <br />2. The applicant shall obtain a building permit from the Building and Safety Division prior <br />to the commencement of any construction. The building developer shall pay any and all <br />fees to which the property may be subject prior to issuance of building permits. <br />3. This design review approval will lapse and shall be void within one year following the <br />effective date of the project approval, unless a building permit is issued or an extension <br />has been approved by the City. <br />4. The building permit plan check materials will be accepted for submittal only afrer <br />completion of the 15 day appeal period, unless the project developer submits a signed <br />statement acknowledging that the plan check fees may be forfeited in the event that the <br />approval is overturned on appeal, or that the design is significantly changed as a result of <br />the appeal. In no case will a building permit be issued prior to the expiration of the 15 <br />day time-period. <br />5. The colors and materials of the proposed addition shall match those of the existing <br />structure. <br />6. If the applicant chooses to eliminate the basement from this project, the floor area <br />presently shown as the staircase may be converted to floor azea for the family room. <br />7. The applicant shall remove a four foot wide strip of concrete from the south side of the <br />site. Its length shall be 47 feet beginning at the existing gate. In this area, the applicant <br />shall install the trees shown in Exhibit "C" covered by this approval. A tree planting plan <br />for this area shall be part of the building permit plan set. The trees shall be installed prior <br />to the final inspection by the Planning Department. All other landscaping may be <br />installed within nine months of occupancy. The applicant shall enter into an agreement <br />with the City, approved by the City Attorney, which guazantees that these will be <br />maintained in a manner consistent with this approval. This agreement shall be recorded <br />against the property as a restrictive covenant before issuance of a building permit. <br />
