Motion passed by a vote of 16-0-0. <br /> Discuss and consider recommendations to the City Council regarding: (1) sale of <br /> flavored tobacco products; (2) sale of e-cigarettes and paraphernalia; (3) sale of <br /> tobacco products within 1,000 feet of public schools, public parks and public recreation <br /> facilities; (4) minimum pack sizes for some cigars and cigarettes; and (5) possession of <br /> tobacco products by persons under 21 years of age <br /> Assistant City Attorney Larissa Seto noted that at its November 21, 2019, meeting the EVC <br /> voted to ask the Youth Commission to meet with tobacco retailers to consider modifications to <br /> the Youth Commission's recommendations. She indicated the Youth Commission has not met <br /> with tobacco retailers as the Youth Commission's December meeting was cancelled, and this <br /> matter is scheduled to proceed to the City Council with the independent recommendations of <br /> each commission and committee. <br /> The EVC was presented with perspectives from the Youth Commission and tobacco retailers <br /> along with the following options to consider when developing its recommendations to City <br /> Council regarding: <br /> 1. Prohibit the sale of flavored tobacco products <br /> a. Support Youth Commission's recommendation to ban sale of flavored tobacco <br /> products <br /> 1 . Exempt menthol <br /> 2. Exempt flavored pipe tobacco <br /> 3. Exempt sales in "tobacco stores" <br /> b. Allow sales by tobacco retailers, but flavored products not visible to customers <br /> ("go dark") <br /> c. No restrictions on the sale of flavored tobacco <br /> 2. Prohibit the sale of e-cigarettes and related paraphernalia <br /> a. Support Youth Commission's recommendation to ban on sale of electronic <br /> smoking devices and related paraphernalia <br /> 1 . Exempt sales in "tobacco stores" <br /> b. Allow sales by tobacco retailers, but not visible to customers ("go dark") <br /> c. No restrictions on sales <br /> 3. Restrict the sale of tobacco products within 1 ,000 feet of public schools, public parks, <br /> and public recreation facilities [with pre-existing tobacco shops being allowed to remain <br /> as legal non-conforming uses] <br /> a. Support Youth Commission's recommendation for 1,000 ft. buffer (exempting <br /> tobacco stores) <br /> 1. Exempt existing retailers/"grandfather" <br /> b. Just 500 ft. buffer from public schools <br /> c. Just 1,000 ft. buffer from public schools <br /> d. Allow sales at all locations, but "go dark" <br />
