THE IT' OF
East Pleasanton Specific Plan
Public CommentspLEASANTON.:
amendment to the inclusionary housing ordinance for off-site credits so that they could proceed
with development of a gated community on the 21 acre school site.
Furthermore, Ponderosa was also involved in a controversial plan that was not ever disclosed as
part of the Busch Property EIR where they planned to remove mature trees planted in the 1960s
and excavate the Martin Avenue buffer zone continuous to Lake Ito use the "fill dirt"for fill on the
Busch Property in a deal to provide a maintenance road for Lake I for Zone 7.
It is not known whether the City of Planning staff that has proposed Ponderosa lead a specific plan
effort is aware of these issues. Nevertheless, it is highly inappropriate for a development
corporation to lead a Specific Plan effort. This leads to serious conflict of interest issues because
by Ponderosa acting in a manner to lead a Specific Plan effort, they are not subject to FPPC
financial interest disclosure rules. Furthermore, to maximize profits, they would naturally propose a
configuration that benefits for the company financially by proposing the maximum number of
housing units with the least amount of open space.
In closing, any Specific Plan committee should be led by citizens of the community, with a chair
elected by members of the citizens committee. The citizens committee should be primarily
composed of nearby residents that are in close proximity to the subject land area.
Should the City of Pleasanton wish to appoint the developer ("Ponderosa") as acting as a
government entity lead in the creation of a Specific Plan, we request that the City of Pleasanton
formulate an advice letter outlining this proposal to the FPPC. Please provide a copy of the advice
letter and the FPPC's response to the Preserve Area Ridgelands Committee.
Sincerely,
Preserve Area Ridgelands Committee
•
•
Provided to City Council for the February 18, 2020, Meeting 15
