The recommendations of the commissions and committee are summarized in <br /> Attachment 6.6 Where applicable, each of the commissions' and committee's <br /> recommendations are noted in each of the topical discussion sections below. <br /> Survey of Alameda County Jurisdictions' Tobacco Restrictions <br /> Many cities within Alameda County, and the County itself, have adopted restrictions on <br /> tobacco sales. Attachment 7 summarizes those regulations, and similar information <br /> was shared with the Youth Commission, EVC, Planning, and Human Services <br /> Commissions as part of their discussions. <br /> SUMMARY OF PROPOSED REGULATIONS <br /> The proposed tobacco regulations include five separate topic areas, each of which is <br /> presented in more detail below: <br /> 1. Restrictions on the sale of flavored tobacco <br /> 2. Restrictions on the sale of electronic smoking devices (e-cigarettes) and related <br /> paraphernalia <br /> 3. Restrictions on the sale of tobacco products, more generally, within a specified <br /> distance from youth gathering places such as schools and parks <br /> 4. Implementation of a Tobacco Retail License (TRL) program <br /> 5. Age limit for legal possession of tobacco products <br /> For each topic, the discussion provides additional background, summarizes the <br /> proposed regulations as recommended by staff, outlines the recommendations made by <br /> the Committee and various Commissions, and presents alternatives that the City <br /> Council could consider, generally based on concepts proposed or recommended in the <br /> Commission/Committee discussion. <br /> 1. Restrictions on Sale of Flavored Tobacco. Federal law since 2009 has prohibited the <br /> sale of flavored cigarettes, except menthol. Neither federal nor state law currently <br /> impose any flavor restrictions on cigars, cigarillos, hookahs or other combustible or <br /> chewing tobacco. As noted above, new federal rules prohibit flavored e-cigarette <br /> cartridge products, except for tobacco and menthol flavors and tank-based systems. <br /> Proposed Regulations <br /> To reduce the availability of flavored tobacco to youth, the proposed ordinance <br /> (Attachment 1) would amend the Municipal Code to: <br /> • Prohibit tobacco retailers citywide from selling flavored tobacco products <br /> (including menthol); but <br /> • Allow flavored tobacco to be sold at tobacco stores. <br /> 6 The Planning Commission was only asked to consider zoning-related tobacco restrictions. <br />
