Resolution No. PC-2003-12 <br />Page 3 <br />EXHIBIT "B" <br />CONDITIONS OF APPROVAL <br />Case PCUP-80 <br />The proposed use shall conform substantially to Exhibit "A," the site plan floor plan, <br />class schedule, and written description from the applicant dated "February 28, 2003," <br />as modified by the project description in the staff report, on file with the Planning <br />Department, except as modified by the following conditions. Minor changes to the <br />exhibits may be allowed subject to the approval of the Planning Director if found to <br />be in substantial conformance to the approved exhibits. The Planning Director may <br />refer changes to the Planning Commission for a public hearing if judged to be <br />substantial. <br />2. Unless otherwise required by the Chief Building Official, the maximum occupancy <br />permitted at the martial arts studio shall be 30 persons. Within thirty (30) days of the <br />effective date of this use permit, the applicant shall post this limit within the tenant <br />space in a location satisfactory with the Chief Building Official. <br />3. Within sixty (60) days of the effective date of this use permit, the applicant shall <br />contact the City Building and Fire Departments and shall obtain all building and other <br />applicable City permits for the use and for any required tenant improvements. Unless <br />otherwise required by the Chief Building Official, the tenant improvements shall <br />include, but are not limited to, the provision of two handicapped-accessible <br />restrooms. <br />4. If the operation of the use results in major conflicts pertaining to parking, noise, <br />traffic, or other impacts, at the discretion of the Planning Director, this conditional <br />use permit may be referred to the Planning Commission for subsequent review at a <br />public hearing. If necessary, the Commission may modify or add conditions of <br />approval to mitigate such impact, or may revoke said conditional use permit. Should <br />noise conflicts arise, mitigation measures that the applicant may be required to <br />implement include, but are not limited to, keeping the doors of the martial arts studio <br />closed at all times or installing noise muffling walls. <br />5. This use permit is not transferable to another address. If the applicant wishes to <br />relocate, the applicant shall secure a new conditional use permit before occupying the <br />new tenant space. <br />6. The use shall be conducted entirely within the building at all times. <br />7. The applicant shall on a regular basis encourage students and staff to use some form <br />of group transit, such as carpools, vanpools, or buses, to travel to and from the martial <br />arts studio. <br />
