In response to Councilmember Testa, Director Clark clarified that for multi-family lots, the City must <br /> allow up to two detached ADUs on the lot and that the Statee does not treat single-family lots with an <br /> ADU as a multi-family lot and there are no parking replacement requirements. <br /> In response to Councilmember Testa's inquiry, Director Clark said there have been reports of concerns <br /> from residents regarding ADUs. <br /> In response to Councilmember Testa's inquiry, City Attorney Dan Sodergren advised the provision in <br /> AB 330 only applies to certain areas designated as urban areas or urban clusters by the HDC and locks <br /> in the housing density of those sites. Assistant City Manager Dolan advised that AB 330 does not take <br /> away the ability to challenge a project. <br /> In response to Councilmember Brown's inquiry, Director Clark clarified that an the ADU does not qualify <br /> as a dense unit towards the City's RHNA numbers. Assistant City Manager Dolan advised that ADUs in <br /> the past could be counted toward moderate housing units. <br /> Ms. Hopkins reported the City took a position on ten bills in four different focus areas which included <br /> transportation, maintaining local control, water, and the environment. She advised only one bill AB 1475 <br /> passed, others became two-year bills and staff will work with the legislative subcommittee to determine <br /> the City's position on bills in the upcoming session. <br /> Assemblymember Rebecca Bauer-Kahan presented an update on this year's session in Sacramento. <br /> She advised that ten of her 13 bills made it to the Governor's desk with all but one being signed into <br /> law. She reported that AB 1532 helps food handlers to receive additional training in dealing with the <br /> public who have food allergies. AB 1475 authorizes the Department of Transportation to engage in a <br /> construction manager/general contractor project delivery method and is a cost-saver for the City. AB <br /> 1086, Tesla Park Protection Bill, was vetoed but continues to be dedicated to protecting the land. She <br /> reported on her work in making higher education more affordable for students living in California. She <br /> addressed her work on regulating out of state for-profit online colleges who being predatory towards <br /> California students; a human trafficking bill which will make it easier and safer for all human trafficking <br /> victims in the criminal justice system; a health care bill to assure all Californians can access Covered <br /> California with no implementation delay; and gun violence prevention bills with one covering inherited <br /> guns which were not clearly defined in current gun laws. She said SB 50 is coming back, and she will <br /> continue to advocate against it. She noted that she is working hard to get the Valley Link Project funded <br /> and addressed the State Budget which put $19 billion in "rainy-day" reserves. She is championing <br /> smart spending within the budget and that she is working with the local fire chiefs on grant funding to <br /> fund fire prevention work and said she supported a $1.4 million all abilities playground that was built in <br /> Dublin that will be used by the entire Tri-Valley. Additionally, she was able to work with the Alameda <br /> District Attorney's Office to fund two dedicated police officers in Alameda County who will focus solely <br /> on illegal dumping. <br /> In response to Mayor Thorne's inquiry, Assemblymember Bauer-Kahan feels the conversation is <br /> starting with the State to discuss their involvement in footing some of the bills for infrastructure needed <br /> to provide affordable housing units. She would also like to see a larger focus on the jobs-housing <br /> balance issue and not thinking of the region as a nine county mega-region which requires residents to <br /> travel in one direction and leaves the housing to cities like Pleasanton. <br /> In response to Councilmember Brown's inquiry, Assemblymember Bauer-Kahan feels that obtaining the <br /> appropriate infrastructure, including safe, clean drinking water is important to include in the <br /> conversation to ensure that infrastructure is matching development. <br /> In response to Councilmember Testa's request, Assemblymember Bauer-Kahan agreed to continue to <br /> advocate for funding for infrastructure and local control. <br /> City Council Minutes Page 4 of 5 December 3, 2019 <br />
