<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-53 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF KEITH BANKS D.B.A. <br />STUDIO 10 DANCE, AS FILED UNDER CASE UP-98-30 <br /> <br />WHEREAS, Keith Banks d.b.a. Studio 10 Dance has applied for a conditional use permit to <br />establish a ballet, tap, and specialty dance studio located at 5424 Sunol Boulevard, <br />Suite 6; and <br /> <br />WHEREAS, zoning for the property is CoN (Neighborhood COmmercial) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of July 8, 1998, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project. <br /> <br />WHEREAS, the Planning COmmission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The site of the proposed use is located in a CoN (Neighborhood Commercial) <br />zoning district which conditionally permits music and dance studios. One of the <br />purposes of the Neighborhood COmmercial district is to provide locations which <br />offer commodities and services to the surrounding residents. The proposed dance <br />studio would provide a physical conditioning service to the community. In <br />addition, other businesses in the Oak Hills Shopping Center could potentially <br />benefit from the presence of the dance studio in that they offer services and <br />merchandise which may appeal to the studio's students or their parents. The <br />conditions of approval proposed for this project give the City the appropriate <br />controls to ensure that the use does not have any negative impacts on the <br />surrounding uses. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially iIljurious to the properties or <br />improvements in the vicinity. <br />
