<br /> PUD-A Lot Less Than One Acre in Size
<br /> The proposed Lot 1 is designated PUD-A, but has a lot size (0.79 acres) which is less than the
<br /> one-acre minimum size required by the NSSP. This configuration is proposed to allow the
<br /> entirety of the creek to be located on a single property, rather than be bisected by a property
<br /> line. From a creek protection and maintenance point of view, it is more logical to have the
<br /> segment of the creek to be located on a single property. Hence, for creek protection and
<br /> maintenance purposes, staff is supportive of could support the PUD-A lot being less than one
<br /> acre in size, if the development is approved as proposed.
<br /> Public Amenity
<br /> If approved, the NSSP amendment for land use change and gain additional lots would confer
<br /> additional land value to the property owner, allowing for the creation, sale, and/or development
<br /> of two more residential units than the three dwelling units currently allowed by the NSSP. The
<br /> applicant initially proposed a monetary contribution of $50,000 toward the creation of a
<br /> Committal Area on the South Hill at the Pleasanton Pioneer Cemetery. At the 2018 workshop
<br /> (which was prior to the applicant proposed the Pioneer Cemetery contribution) the Planning
<br /> Commission suggested that a contribution towards bicycle and pedestrian related projects
<br /> might also be appropriate.
<br /> Recently, the applicant indicated that the amenity contribution would be made only if the
<br /> proposed five-lot residential development is approved. No amenity contribution has been
<br /> considered or proposed for an approval of less than 5 lots. Staff believes a contribution to the
<br /> Pleasanton Pioneer Cemetery should be provided by the applicant for any number lots beyond
<br /> that currently allowed by the NSSP. If an approval is rendered for number of lots exceeding
<br /> that allotted by the NSSP, staff will include a condition requiring funding contribution to
<br /> Pleasanton Pioneer Cemetery, or to bicycle and pedestrian trail related projects as suggested
<br /> by the Planning Commission at the work session.
<br /> PUD Development Plan
<br /> All development proposals in the NSSP area are subject to the PUD review and approval
<br /> process as outlined in the Pleasanton Municipal Code, including adoption of a site-specific
<br /> PUD development plan that includes the development standards for the property. The
<br /> development standards should be consistent with the development standards stated in the
<br /> NSSP.
<br /> Analysis
<br /> Municipal Code Objectives: Section 18.04.101 of the Pleasanton Municipal Code (PMC) sets
<br /> forth objectives for all projects to promote the public health, safety, peace, comfort,
<br /> convenience, prosperity and general welfare, including:
<br /> 1. To provide a precise guide for the physical development of the city in such a manner as
<br /> to achieve progressively the arrangement of land uses depicted in the general plan
<br /> adopted by the city council; and
<br /> 2. To promote the stability of existing land uses that conform with the general plan and to
<br /> protect them from inharmonious influences and harmful intrusions.
