Resolution No. PC-99-9f Page 4 Exhibit "B" Conditions of Approval Case AP-99-09 (Appeal of Case UP-99-01) Large-Family Day-Care 4350 First Street I. The large-family day-care center shall be limited to the activities proposed in the applicant's written narrative, site plan, and floor plan, "Exhibit A," dated "Received December 30, 1998," on file with the Planning Department except as modified by these conditions. Minor changes to the plans may be allowed subject to the approval of the Planning Director if found to be in substantial conformance with the approved exhibits. 2. The large-family day-care center shall be limited to a maximum enrollment of twelve children, including children under the age of ten who reside at the center. 3. All children enrolled at the large-family day-care center shall be dropped off after 7:00 a.m. and picked up before 7:00 p.m. 4. If operation of the use results in conflicts pertaining to parking, noise, traffic, or other factors, at the discretion of the Planning Director, this matter can be submitted to the Zoning Administrator for subsequent review at a public hearing. If necessary, the Zoning Administrator may modify or add conditions of approval to mitigate such impacts, or may refer the use permit to the Planning Commission for subsequent review at a public hearing. 5. The hours of operation shall be Monday through Friday from 7:00 a.m. to 7:00 p.m.. Any changes in the hours of operation of the day-care shall be subject to the Planning Director's review and approval. 6. All appropriate State licenses for a large-family day-care center shall be secured and maintained during the entire time the residence is utilized as a large-family day-care center. 7. The applicant shall meet all requirements of the State Fire Marshall related to large-family day-care centers. 8. The applicant's garage shall be made available to park one vehicle. The applicant's south western side yard shall not be used as a play area and the applicant's driveway shall be made available to park two cars. 9. During business hours, all automobiles owned or operated by the applicant, residents, or employees shall not be parked in the on-street parking spaces directly in front of the applicant's residence or in the applicant's driveway space closest to First Street.
