<br />Resolution No. PC-99-9f <br />Page 4 <br /> <br />Exhibit "B" <br />Conditions of Approval <br />Case AP-99-09 (Appeal of Case UP-99-01) <br />Large-Family Day-Care <br />4350 First Street <br /> <br />I. The large-family day-care center shall be limited to the activities proposed in the <br />applicant's written narrative, site plan, and floor plan, "Exhibit A," dated "Received <br />December 30, 1998," on file with the Planning Department except as modified by these <br />conditions. Minor changes to the plans may be allowed subject to the approval of the <br />Planning Director if found to be in substantial conformance with the approved exhibits. <br /> <br />2. The large-family day-care center shall be limited to a maximum enrollment of twelve <br />children, including children under the age of ten who reside at the center. <br /> <br />3. All children enrolled at the large-family day-care center shall be dropped off after 7:00 <br />a.m. and picked up before 7:00 p.m. <br /> <br />4. If operation of the use results in conflicts pertaining to parking, noise, traffic, or other <br />factors, at the discretion of the Planning Director, this matter can be submitted to the <br />Zoning Administrator for subsequent review at a public hearing. If necessary, the Zoning <br />Administrator may modify or add conditions of approval to mitigate such impacts, or <br />may refer the use permit to the Planning Commission for subsequent review at a public <br />hearing. <br /> <br />5. The hours of operation shall be Monday through Friday from 7:00 a.m. to 7:00 p.m.. Any <br />changes in the hours of operation of the day-care shall be subject to the Planning <br />Director's review and approval. <br /> <br />6. All appropriate State licenses for a large-family day-care center shall be secured and <br />maintained during the entire time the residence is utilized as a large-family day-care <br />center. <br /> <br />7. The applicant shall meet all requirements of the State Fire Marshall related to <br />large-family day-care centers. <br /> <br />8. The applicant's garage shall be made available to park one vehicle. The applicant's south <br />western side yard shall not be used as a play area and the applicant's driveway shall be <br />made available to park two cars. <br /> <br />9. During business hours, all automobiles owned or operated by the applicant, residents, or <br />employees shall not be parked in the on-street parking spaces directly in front of the <br />applicant's residence or in the applicant's driveway space closest to First Street. <br />
