<br />Resolution No. PC-99-9t <br />Page 2 <br /> <br />The subject site is zoned RM-4,OOO Multi-Family Residential Zoning District. A <br />large-family day care home is allowed on a lot with a single-family dwelling in a <br />multi-family residential district subject to the standards in the Municipal Code. <br />The objectives of the Zoning Ordinance include: protecting existing land uses <br />from inharmonious influences and harmful intrusions; fostering harmonious, <br />convenient, workable relationships among land uses; and ensuring that public and <br />private lands ultimately are used for the purposes which are most appropriate and <br />beneficial to the City as a whole. The Planning Commission believes that the <br />proposed day care would be consistent with the objectives of the zoning ordinance <br />since it would retain the mixed use (i.e., residential and commercial) character of <br />First Street and would provide a needed service to the community. After reading <br />the staff report and listening to public testimony, the Planning Commission <br />believes that the use, as conditioned, would not create a traffic hazard and would <br />be compatible with surrounding uses. <br /> <br />For the reasons stated above, the Planning Commission believes that this finding <br />can be made to allow the day care provider to enroll a maximum of twelve <br />children, as conditioned. <br /> <br />2. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to properties or <br />improvements in the vicinity. <br /> <br />After reading the staff report and listening to public testimony, the Planning <br />Commission believes that the use meets the required noise, parking, and <br />separation standards for a large-family daycare. As stated above, the Planning <br />Commission does not believe the use, as conditioned, would create a traffic <br />hazard. The use, as conditioned, would be required to meet the standards of the <br />Fire Code. For the reasons listed above, the Planning Commission believes that <br />the project, as conditioned, would not be detrimental to the public health, safety, <br />and welfare. <br /> <br />The Planning Commission believes that this finding can be made to allow the day <br />care provider to enroll a maximum of twelve children, as conditioned. <br /> <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />The Planning Commission believes that as conditioned, the use will meet the <br />separation, noise, parking, traffic, and Fire Code requirements. For this reason, the <br />Planning Commission believes the use will comply with each applicable provision <br />of this chapter and that this finding can be made to allow the day care provider to <br />enroll a maximum of twelve children, as conditioned. <br />
