<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-94 <br /> <br />RESOLUTION GRANTING APPROVAL OF CASE AP-99-09, THE APPEAL OF A <br />DECISION OF THE ZONING ADMINISTRATOR'S DENIAL OF THE <br />APPLICATION OF BADlEH V ARASTEH FOR A CONDITIONAL USE PERMIT, AS <br />FILED UNDER CASE UP-99-01 <br /> <br />WHEREAS, Badieh Varasteh has applied for a conditional use permit to operate a large-family <br />day-care facility for 12 children at an existing residence located at 4350 First <br />Street; and <br /> <br />WHEREAS, zoning for the property is RM-4,000 (Multi-Family Residential) District; and <br /> <br />WHEREAS, at its meeting of March 23, 1999, the Zoning Administrator granted approval of <br />the conditional use permit for eight children, with no age restriction, and <br />determined that a traffic study to assess potential traffic problems if the day-care <br />were to expand to a maximum of twelve children be conducted over the next six <br />months; and <br /> <br />WHEREAS, on September 27, 1999, following review of the results of the traffic study, the <br />Zoning Administrator denied a further expansion up to a maximum of twelve <br />children; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant filed an <br />appeal of the Zoning Administrator's denial; and <br /> <br />WHEREAS, at its duly noticed public hearing of November 10, 1999, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />I. The proposed location of the conditional use is in accordance with the <br />objectives of the Zoning Ordinance and the purpose of the district in <br />which the site is located. <br />
