Compare Versions Page 20 of 22 <br /> (i) The site has been subject to a Letter of Map Revision prepared by the Federal Emergency Management Agency <br /> and issued to the local jurisdiction. <br /> (ii) The site meets Federal Emergency Management Agency requirements necessary to meet minimum flood plain <br /> management criteria of the National Flood Insurance Program pursuant to Part 59 (commencing with Section <br /> 59.1)and Part 60(commencing with Section 60.1)of Subchapter 8 of Chapter I of Title 44 of the Code of Federal <br /> Regulations. <br /> (3)The residential development has a minimum density of 30 dwelling units per acre in jurisdictions considered <br /> metropolitan,as defined in subdivision(f)of Section 65583.2, or a minimum density of 20 dwelling units per acre <br /> in jurisdictions considered suburban,as defined in subdivision(e)of Section 65583.2. <br /> (4) The residential development is located within a one-half mile radius of a major transit stop and within a city <br /> with a population greater than 50,000. <br /> (c) Notwithstanding any other law, a project that qualifies for an equitable communities incentive may also apply <br /> for a density bonus, incentives or concessions, and parking ratios in accordance with subdivision (b) of Section <br /> 65915. To calculate a density bonus for a project that receives an equitable communities incentive, the <br /> "otherwise maximum allowable gross residential deflsity"density," as described in subdivision (f) of Section <br /> 6594-5 65915, shall be equal to the proposed number of units in, or the proposed square footage of, the <br /> residential development after applying the equitable communities incentive received pursuant to this chapter. In <br /> no case may a city, county, or city and county apply any development standard that will have the effect of <br /> physically precluding the construction of a development meeting the criteria of this chapter and subdivision (b)of <br /> Section 65915 at the unit count or square footage or with the concessions or incentives permitted by this chapter <br /> and as may be increased under Section 65915 in accordance with this subdivision, but no additional waivers or <br /> reductions of development standards, as described in subdivision (e)of Section 65915 shall be permitted. <br /> 65918.56. <br /> 65918.56.(a)The local government shall grant an incentive requested by an eligible applicant pursuant to this <br /> chapter unless the local government makes a written finding, based on substantial evidence, that the incentive <br /> would have a specific, adverse impact on any real property or historic district that is listed on a federal or state <br /> register of historical resources and for which there is no feasible method to satisfactorily mitigate or avoid the <br /> specific, adverse impact without rendering the development unaffordable. <br /> (b)An eligible applicant proposing a project that meets all of the requirements under Section 65913.4 may <br /> submit an application for streamlined, ministerial approval in accordance with that section. <br /> (c) The local government may modify or expand the terms of an equitable communities incentive provided <br /> pursuant to this chapter, provided that the equitable communities incentive is consistent with, and meets the <br /> minimum standards specified in, this chapter. <br /> 6694844.65918.57. The Legislature finds and declares that this chapter addresses a matter of statewide concern <br /> rather than a municipal affair as that term is used in Section 5 of Article XI of the California Constitution. <br /> Therefore,this chapter applies to all cities, including charter cities. <br /> 6494446.65918.58. (a)On or before July 1, 2020,2023, Sections 65918.51 to 65918.54, inclusive, shall not <br /> apply to a potentially sensitive community.
