For purposes of this paragraph, "highest allowable height" <br /> means the tallest height, including heights that require conditional approval, allowable pursuant to zoning and <br /> any specific or area plan that covers the parcel. <br /> (3)Any requirement governing the relationship between the size of the parcel and the area that the building may <br /> occupy that would restrict the structure to a FAR of less than 0.6 times the number of stories proposed for the <br /> project. <br /> (4)A waiver from minimum automobile parking requirements,as follows: <br /> (A) If the residential development is located within a one-quarter mile radius of a rail transit station in a city with <br /> a population of greater than 100,000, based on the most recent United States Census Bureau data, the <br /> residential development project shall receive a waiver from any minimum automobile parking requirement. <br /> (B)If the residential development does not meet the criteria specified in clause (i),subparagraph (A), the <br /> residential development project shall receive a waiver from minimum automobile parking requirements of more <br /> than 0.5 parking spaces per unit. <br /> (b) To be eligible for an equitable communities incentive outlined in subdivision (a), a residential development <br /> shall meet all of the following requirements: <br /> (1) The site satisfies the requirements specified in paragraph(2)of subdivision(a)of Section 65913.4. <br /> (2) The site is not located within either of the following: <br /> (A)An architecturally or historically significant historic district, as defined in subdivision (h) of Section 5020.1 of <br /> the Public Resources Code. <br /> (B)A special flood hazard area subject to inundation by the 1-percent annual chance flood (100-year flood), as <br /> determined by the Federal Emergency Management Agency in any official maps published by the Federal <br /> Emergency Management Agency. If a development proponent is able to satisfy all applicable federal qualifying <br /> criteria in order to provide that the site satisfies this subparagraph and is otherwise eligible for an equitable <br /> communities incentive under this chapter, a local government shall not deny the application on the basis that the <br /> development proponent did not comply with any additional permit requirement, standard, or action adopted by <br /> that local government that is applicable to that site.
