THE CITY OF <br /> ""m "" CITY COUNCIL AGENDA REPORT 18 <br /> pL£ASANTON. <br /> January 21, 2019 <br /> Operations Services <br /> TITLE: APPROVE A PROFESSIONAL SERVICES AGREEMENT WITH WEST <br /> YOST ASSOCIATES FOR THE NOT TO EXCEED AMOUNT OF $241,661 <br /> TO PERFORM A RISK AND RESILIENCE ASSESSMENT AND REVISE <br /> THE EMERGENCY RESPONSE PLAN PER THE REQUIREMENTS OF <br /> AMERICA'S WATER INFRASTRUCTURE ACT OF 2018 <br /> SUMMARY <br /> America's Water Infrastructure Act of 2018 (AWIA) was signed into law in October 2018. <br /> Under this law, utilities are required to perform Risk and Resilience Assessments (RRA) <br /> and revise Emergency Response Plans (ERP) related to their water systems. Utilities <br /> must certify to the United States Environmental Protection Agency (USEPA) that they <br /> have met these new requirements. Non-compliance with these new requirements may <br /> result in fines of up to $25,000 per day. <br /> Staff recommends awarding a professional services agreement with West Yost <br /> Associates (West Yost) to assure compliance with the AWIA by performing a risk and <br /> resilience assessment of the City's water system and assisting staff in revising the ERP. <br /> RECOMMENDATION <br /> 1. Authorize the City Manager to approve a professional services agreement with <br /> West Yost for a not-to-exceed amount of$241,661 to perform a RRA and revise the <br /> ERP. <br /> 2. Allocate $250,000 from Fund 421 Water Replacement Capital Improvement to fund <br /> this project. <br /> FINANCIAL STATEMENT <br /> The anticipated total project expenditures for this project is $241,661, which includes a <br /> ten percent contingency of $21,969 for unforeseen circumstances and related extra <br /> services as determined to be necessary by the City. Currently, there is no allocation of <br /> funds for this project as it was not anticipated at the time of development of the Fiscal <br /> Year 2019-20 CIP. Staff recommends allocating $250,000 from Fund 421 Water <br /> Replacement Capital Improvement to fund this project. <br />
