BACKGROUND On March 23, 2016, the Planning Commission recommended City Council approve PUD-120, a Planned Unit Development (PUD) application by KN St. John LP to construct ten new town homes, relocate one existing home and create one common area parcel located on an approximately 0.73-acre site at 536 and 550 St. John Street. On October 4, 2016, City Council approved PUD-120 and adopted Ordinance No. 2151. On November 7, 2017, the City Council approved the final map, improvement plans, and subdivision agreement for Tract 8326. DISCUSSION Construction of Subdivision Improvements The subdivision agreement provided for the construction of public utilities within the private streets, and construction of public improvements within St. John Street, to serve the ten new lots. Public Improvements The public improvements serving the ten new lots that will be operated and maintained by the City include: • A public sanitary sewer main, a public water main up to the water meters located within public right-of-way, dedicated public service easements and the private street (Wise Way); and • A public streetlight within the St. John Street right-of-way; and • A public storm drain system installed in St. John Street. Private Improvements The private improvements serving the ten new lots that will be operated and maintained by the homeowners association as provided for in the Declaration of Covenants, Conditions and Restrictions of Tract 8326 KN St. John Declaration of Restrictions (CC&Rs), which was recorded on December 13, 2017, in the official records of Alameda County (2017-273989) and the Stormwater Treatment Measures Inspection and Maintenance Agreement, which was recorded in the official records of Alameda County include: • The private streets (Wise Way) and the following improvements within this street: sidewalks, storm drain systems, streetlights, landscaping and irrigation, and related improvements; and • Six bio-retention areas located within Tract 8326; and • Mailboxes and their associated support structure located in St. John Street planter strip.
