BACKGROUND <br /> On May 13, 2015, the Planning Commission recommended City Council approval of <br /> PUD-81-30-89D, a Planned Unit Development (PUD) application by Summerhill Homes <br /> to construct 94 condominium units and create nine common open space lots located on <br /> an approximately 5.9-acre site at 5850 W. Las Positas Blvd. On July 21, 2015, City <br /> Council adopted Ordinance No. 2121, approving PUD-81-30-89. <br /> On June 24, 2015, the Planning Commission approved an application by SummerHill <br /> Homes for Vesting Tentative Map 8246 to subdivide an approximately 5.9-acre site <br /> located at 5850 W. Las Positas Blvd. into 94 condominium units and nine common open <br /> space lots consistent with the approved PUD. <br /> On December 15, 2015, the City Council approved the final map, improvement plans, <br /> and the subdivision agreement for Tract 8246. <br /> DISCUSSION <br /> Construction of Subdivision Improvements <br /> The subdivision agreement provided for the construction of both public and private <br /> utilities within the private streets, and public improvements within public right-of-way of <br /> W. Las Positas Boulevard and Hacienda Drive to serve the 94 condominium units. <br /> Public Improvements <br /> The public improvements serving the 94 condominium units that will be operated and <br /> maintained by the City include: <br /> • A public sanitary sewer main, a public water main, and public fire hydrants <br /> located within dedicated public service easements and the private streets <br /> (Barcenilla Lane, Serra Circle, Quintana Terrace, Taboada Lane, Purisma <br /> Terrace, Arcangel Terrace); and <br /> • An upgraded traffic signal at the intersection of W. Las Positas Boulevard and <br /> Hacienda Drive. <br /> Private Improvements <br /> The private improvements serving the 94 condominium units that will be operated and <br /> maintained by the homeowners association as provided for in the Declaration of <br /> Covenants, Conditions and Restrictions of Andares, which was recorded on May 3, <br /> 2016, in the official records of Alameda County (2016-112087) and in the Stormwater <br /> Treatment Measures Inspection and Maintenance Agreement, which was recorded on <br /> October 15, 2018, in the official records of Alameda County (2018-200214) include: <br /> • The private streets (Barcenilla Lane, Serra Circle, Quintana Terrace, Taboada <br /> Lane, Purisma Terrace, Arcangel Terrace), pedestrian walkways and the <br /> following improvements within those streets: ADA ramps, storm drain systems, <br /> street lights, landscaping and irrigation, bio-retention areas and related <br /> improvements; and <br /> • Clustered mailboxes; and <br /> • Decorative pavements in public right-of-way, public service easement, and within <br /> shared private driveway (Ref: Section 4.2.4 of CC&R); and <br /> Page 2 of 3 <br />
