<br />EXHIBIT "B" <br />The Wine Steward <br />UP-99-53, 641 Main Street <br /> <br />1. Annroved Use. The proposed use shall substantially conform to the floor plan and narrative, <br />Exhibit "A", dated "Received September 29, 1999", on file with the Planning Department, except <br />as modified by the following conditions. Minor alterations may be approved by the Planning <br />Director if found to be in substantial conformance with this approval. The business may operate <br />during the following hours: <br /> <br />Monday through Wednesday, from 10:00 a.m. until 8:00 p.m. <br />Thursday through Saturday, from 10:00 a.m. until 9:00 p.m. <br />Sundays, from II :00 a.m. until 6:00 p.m. <br /> <br />Classes and seminars may be held in the mezzanine level, up to ten days a month, from 7:00 p.m. <br />until 10:00 p.m. <br /> <br />2. VestinlZ. This Conditional Use Permit shall become effective fifteen days following the date of <br />approval of said use permit by the Planning Commission, unless an appeal has been taken to the <br />Council, or unless the council elects to review the decision of the Planning Commission. <br /> <br />3. Revocation. If any elements of the proposed use result in conflicts pertaining to parking, <br />noise, traffic, loitering, or other impacts, at the discretion of the Planning Director, this use <br />permit may be submitted to the Planning Commission for subsequent review at a public hearing. <br />This would include nuisances created through the operation of the alcohol sales or school <br />components of this use, either within the mezzanine level, by its patrons in the first floor retail <br />area, or other areas either in or outside the building. If necessary, the Commission may modify or <br />add conditions of approval to mitigate such impacts, or may revoke said use permit. <br /> <br />4. Code Comoliance. The applicant shall contact the Building and Fire Departments to <br />determine all applicable requirements. The structure must be made to conform to all <br />applicable occupancy requirements, codes, and ordinances of the City. All future tenant <br />improvements shall be included as part of this condition. <br /> <br />5. Required Permits. The applicant shall obtain all applicable City, County, Regional, State <br />and Federal permits for the proposed uses of the subject site. <br /> <br />6. Recycling. The applicant shall provide sufficient space within the interior portion of the leased <br />space for storing waste cardboard and glass for recycling, and shall ensure that the accumulated <br />materials are deposited at a recycling facility on a weekly basis. The disposal of cardboard or <br />glass items into the commercial garbage waste stream by this use is expressly prohibited. <br /> <br />7. DesilZn Review. Within 60 days from obtaining Conditional Use Permit approval, the <br />applicant shall submit an application for Design Review depicting the proposed building <br />facade and display window improvements. The application shall be in conformance with <br /> <br />Pleasanton Municipal Code Section 18.74-050. <br /> <br />8. SilZnage. Any proposed signs shall be reviewed and approved in conformance with Pleasanton <br />Municipal Code Section 18.96. <br /> <br />9. Orderly Maintenance. The applicant shall maintain the area surrounding the tenant space in a <br />clean and orderly manner at all tirnes. <br />
