The uses proposed will comply with applicable Building and Fire Codes. The Police Department staff has no objections to the subject proposal. As conditioned, the uses could be referred back to the Planning Commission should unanticipated impacts be present. 3. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. As conditioned, the proposed use will comply with all provisions and requirements of the City's zoning ordinance. WHEREAS, the Planning Commission determined that the proposed use, as conditioned, would be compatible with the surrounding uses or properties. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Section 2. Approves Case UP-99-53, the application of the Wine Steward (Joe Sasek) for a conditional use permit to operate a wine store, and to permit holding seminars in conjunction with the proposed wine store and other ancillary uses located at 641 Main Street, subject to the conditions shown in Exhibit "B," attached hereto and made part ofthis case by reference. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
