Approval of Case UP-99-56 shall be contingent upon approval of Case PUD-85-15-IIM <br />by the City Council and approval of Case Z-99-235. <br /> <br />2. The proposal shall conform substantially to the site plan, Exhibit A (dated "Received <br />September 29,1999"), on file with the Planning Department except as modified by the <br />following conditions. <br /> <br />3. The applicant shall obtain and pay for all the necessary City permits for the construction <br />of the second unit, including any additional sewer connection, water meter, and DSRSD <br />fees required for second units. <br /> <br />4. Only one residential unit on the subject property may be rented. The other unit shall be <br />owner-occupied. The second unit shall be occupied by no more than two adults, although <br />there shall be no limit on the number of children. The applicant shall prepare a deed <br />restriction to this effect and shall submit it to the City Attorney for review and approval <br />prior to recordation. The recordation shall be accomplished prior to the installation of the <br />stove in the second unit. <br /> <br />5. In no case shall the second unit be sold, subdivided, or held under different legal <br />ownership from the primary residence. The applicant shall prepare a deed restriction to <br />this effect and shall submit it to the City Attorney for review and approval prior to <br />recordation. The recordation shall be accomplished prior to the installation of the stove <br />in the second unit. <br /> <br />6. One parking space shall be made continuously available to the occupant(s) of the second <br />unit for parking. The parking space dedicated for use by occupants of the second unit <br />shall be in the existing garage. In the event that the occupant( s) of the second unit own <br />and operate more than one auto, all vehicles shall be accommodated on-site, but the <br />parking area for the second unit shall not interfere with the three off-street guest parking <br />spaces required by the Golden Eagle PUD. <br /> <br />7. The applicant shall install address signs that clearly are visible from the street during <br />daylight and night time hours and which clearly indicate that two separate units exist on <br />the parcel to the satisfaction of the Fire Marshall. The applicant shall obtain the new <br />street address for the second unit from the Planning Department. <br /> <br />8. The resident owner(s) shall be signatory to any lease agreement for the property. <br />
