PC-99-89 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF GARY MONZO FOR <br />DESIGN REVIEW APPROVAL AND A CONDITIONAL USE PERMIT, AS FILED <br />UNDER CASE Z-99-235/UP-99-56 <br /> <br />WHEREAS, Gary Monzo has applied for design review of an approximately 2,178 square-foot <br />first- and second-story addition to an existing residence and a conditional use <br />permit for an attached second unit located at 8023 Golden Eagle Way; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development - Low Density <br />Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of October 27,1999, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements ofthe <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />I. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to establish a second unit within the residence conforms with the <br />objectives and purposes of the Municipal Code and the Golden Eagle PUD. State <br />law considers second units as a single-family use. The proposal would maintain <br />the existing single-family character of the Golden Eagle Farm development <br />because the unit is designed as part ofthe home, indistinguishable from the <br />exterior as a second unit. The second unit constitutes 15% of the total house <br />living area. In addition, a recommended condition of approval -- standard for all <br />second units in the City -- requires that either the primary residence or the second <br />unit be owner-occupied and that a maximum of two adults shall be allowed to <br />reside in the unit. <br />
