<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-88 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF GARY <br />MONZO FOR MODIFICATIONS TO AN APPROVED PLANNED UNIT <br />DEVELOPMENT AS FILED UNDER CASE PUD-85-15-IIM <br /> <br />WHEREAS, Gary Monzo has applied for I) a modification to the approved development plan <br />for PUD-85-15 (Golden Eagle Farm) to allow an existing residence to encroach <br />within the front and northern side yard; and 2) a modification to the approved <br />development plan to further reduce the northern side yard setback for a proposed <br />addition located at 8023 Golden Eagle Way; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR (Low Density <br />Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of October 27, 1999, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The plan is in the best interests of the public health, safety, and general <br />welfare. <br /> <br />The proposed modification to reduce the required front yard setback from 30 feet <br />to 29.5 feet and to reduce the northern side yard setback from 20 feet to 15.5 feet <br />would not compromise the best interests of the public health, safety, and general <br />welfare. The structure and the revised site plan has been designed and would be <br />built to conform to all relevant City building codes. New landscaping plan would <br />provide screening between the structure and the adjacent properties. <br /> <br />B. The plan is consistent with the City's General Plan. <br /> <br />The decrease in the setback would have no impact on any existing trees on the <br />subject lot or on any adjacent lot. As required by the General Plan, the Building <br />Department would ensure that the building foundation is constructed on <br />satisfactorily compacted fill and that erosion control measures will be <br />implemented. No portion of the site is located in a flood hazard zone. The <br />proposed plan does not affect other General Plan policies and, by its conformance <br />
