Notwithstanding the developer's participation in such a program, <br />the City may withhold building permits if the City determines that sufficient water <br />is not available at the time of application of building permits. <br /> <br />Planning Requirements: <br /> <br />8. At no time shall balloons, banners, pennants, or other attention-getting devices be <br />utilized on the site except as allowed by Section 18.96.060K of the Zoning Ordi- <br />nance for grand openings. At no time shall spot lighting be used after 10:00 PM in <br />conjunction with such grand openings and/or promotional events. <br /> <br />9. If operation of the uses located in this building results in parking demand exceed- <br />ing the supply of on-street and off-street parking spaces, this design review ap- <br />proval will be reviewed for the implementation of measures to ensure the supply of <br />parking to meet demand. Such measures may include, but are not limited to, <br />modifying operating hours of the businesses, paving additional parking spaces on <br />adjoining vacant properties, etc. At the discretion of the Planning Director, this is- <br />sue may be referred to the Planning Commission for review. <br /> <br />10. The perimeter fence and security gate shall be constructed of galvanized chain link <br />material. This detail shall be shown on the building permit plan set for review and <br />approval by the Planning before issuance of a building permit. <br /> <br />11. Cars under repair shall not be parked outside ofthe security gates. <br /> <br />12. The applicant shall work with staff to develop architecture designs and/or treat- <br />ments to mitigate the appearance of the intake/exhaust stacks of the proposed paint <br />spray booth to Del Valle Parkway and Bernal Avenue. If such means are infeasi- <br />ble, the project developer shall then be required to locate the paint spray booth to- <br />wards the rear interior building wall of the tenant space. This change shall be <br />shown on the tenant improvement drawings submitted for review and approval by <br />the Planning Director before issuance of a building permit. <br /> <br />13. Except for the intake/exhaust stacks of the above-mentioned paint spray booth, all <br />roof-mounted mechanical equipment shall be designed, installed, and maintained <br />so as not project above a horizontal plane established by the building's parapet <br />walls. This requirement may be waived by the Planning Director if it can be dem- <br />onstrated via site-line analyses that the pipe is not visible to Bernal Avenue and <br />Del Valle Parkway. <br /> <br />Final Conditions of Approval per Planning Commission <br />2-99-228, Commercial Service Building <br /> <br />October 14, 1999 <br />Page 2 of 11 <br />
