Ordinance No. <br /> Page 4 <br /> 5. Whether streets, buildings, and other manmade structures have been <br /> designed and located in such manner to complement the natural terrain <br /> and landscape: <br /> The subject parcel is in a developed area of the City and would not involve the <br /> extension of any new public streets. The site is relatively flat and thus the <br /> proposed building pad for the new commercial building and related site <br /> improvements do not require extensive grading and do not contrast unfavorably <br /> with the natural terrain. The Project will be compatible in design, size and scale <br /> with surrounding structures. Eleven existing trees will be removed to <br /> accommodate the Project. The removal of these trees would be mitigated by the <br /> installation of 21 new trees. If the value of the new trees is not equal to or greater <br /> than the appraised value of the trees to be removed, the applicant would be <br /> required to pay the difference into the City's Urban Forestry Fund. Therefore, the <br /> City Council finds that the Project complements the natural terrain and there is <br /> adequate landscaping. <br /> 6. Whether adequate public safety measures have been incorporated into the <br /> design of the plan: <br /> The subject parcel currently provides adequate access for police, fire, and other <br /> emergency vehicles. The new commercial building would be equipped with <br /> automatic fire suppression systems (sprinklers). Structures would be required to <br /> meet the requirements of the California Building Code, Fire Code, other <br /> applicable City codes, and State of California energy and accessibility <br /> requirements. Site specific soils analyses would be conducted in conjunction with <br /> the building permit review. <br /> Therefore, the City Council finds that the Project has been designed to <br /> incorporate adequate public safety measures. <br /> 7. Whether the plan conforms to the purposes of the PUD District: <br /> The proposed PUD development plan conforms to the purposes of the PUD <br /> district. One of these purposes is to ensure that the desires of the developer and <br /> the community are understood and approved prior to commencement of <br /> construction. The Planning Commission finds that the Project implements the <br /> purposes of the PUD ordinance by providing a new commercial building and <br /> related site improvements that are well-designed and sited on the subject parcel. <br /> In addition, the Project fulfills the desires of the applicant, and meets the City's <br /> General Plan goals and policies. The PUD process allows for ample input from <br /> the public and for an ultimate decision by the City Council regarding <br /> appropriateness of the proposed uses and development plan. <br /> The City Council finds that through the PUD process the Project has provided <br /> residents, the applicant and the City with a development plan that optimizes the <br /> re-use of this site in a sensitive manner. <br />
