THE CITY OF 13 <br /> CITY COUNCIL AGENDA REPORT <br /> pLEASANTON. <br /> December 17, 2019 <br /> Community Development <br /> Planning Division <br /> TITLE: INTRODUCTION OF AN ORDINANCE TO APPROVE APPLICATIONS <br /> FOR PLANNED UNIT DEVELOPMENT (PUD) REZONING AND <br /> DEVELOPMENT PLAN TO: (1) DEMOLISH THE EXISTING <br /> APPROXIMATELY 3,510-SQUARE-FOOT RESTAURANT BUILDING; <br /> (2) REZONE THE SUBJECT PARCEL FROM C-F (FREEWAY <br /> COMMERCIAL) DISTRICT TO PUD-C (PLANNED UNIT <br /> DEVELOPMENT — COMMERCIAL) DISTRICT; AND (3) CONSTRUCT <br /> AN APPROXIMATELY 10,980-SQUARE-FOOT, SINGLE-STORY, <br /> MULTI-TENANT COMMERCIAL BUILDING AND RELATED SITE <br /> IMPROVEMENTS LOCATED AT 6455 OWENS DRIVE <br /> SUMMARY <br /> The proposed project would demolish the existing approximately 3,510-square-foot <br /> restaurant building located at 6455 Owens Drive (formerly Denny's) and construct an <br /> approximately 10,980-square-foot, single-story, multi-tenant commercial building and <br /> related site improvements. Additionally, the property would be rezoned from C-F District <br /> to PUD-C District with a defined uses list. The Planning Commission recommended <br /> approval of the applications on September 25, 2019, including modified conditions of <br /> approval (COA's). The applications are now before the City Council for consideration. <br /> PLANNING COMMISSION SUMMARY <br /> On September 25, 2019, the Planning Commission, after taking public testimony and <br /> discussion of the proposal, on a 3-0 vote recommended approval of the applications <br /> based on the project analysis and PUD considerations. The modified conditions were <br /> related to: (1) distinguishing coffee, bagel and donut shops from the broader category of <br /> restaurant and catering establishments, and requiring coffee, bagel and donut shop <br /> uses to obtain a Conditional Use Permit (CUP) due to their potentially high morning <br /> (AM) peak hour trip generation rates; and (2) restricting occupancy of the new <br /> commercial building pending the completion of construction, by the City, of a planned <br /> righthand turn pocket from southbound Hopyard Road onto Owens Drive. The Planning <br /> Commission modified conditions are provided in Attachment 1. The Planning <br /> Commission agenda report and excerpted meeting minutes are included as <br /> Attachments 3 and 4. <br />
