EXHIBIT A <br /> RESOLUTION NO. PC-2019-26 <br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br /> PLEASANTON APPROVING THE APPLICATIONS FOR CONDITIONAL USE <br /> PERMIT (CUP) AND DESIGN REVIEW (DR) LOCATED AT 7139 KOLL CENTER <br /> PARKWAY, AS FILED UNDER CASE NOS. P19-0190 (CUP) AND P19-0191 (DR) <br /> WHEREAS, on July 16, 2019, Joseph Hartley, on behalf of Blue Oaks Church, <br /> applied for: (1) Conditional Use Permit approval to operate a religious facility within an <br /> existing building; and (2) Design Review approval to construct related building and site <br /> improvements at 7139 Koll Center Parkway; and <br /> WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development- <br /> Industrial/Commercial-Office) District; and <br /> WHEREAS, religious facilities are a conditionally permitted use in the subject <br /> District, and require Planning Commission approval of a CUP; and <br /> WHEREAS, the project is categorically exempt from the California <br /> Environmental Quality Act (CEQA) pursuant to Section 15301, Class 1, Existing <br /> Facilities; and <br /> WHEREAS, on December 11, 2019, the Planning Commission held a duly- <br /> noticed public hearing and considered the staff report (which advised that the Bernal <br /> Corporate Park Owners Association is in support of the applications), relevant exhibits, <br /> recommendations of the City staff concerning this application, and received testimony <br /> from the applicant and interested parties. <br /> NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City <br /> of Pleasanton, based on the entire record of proceedings, including the oral and written <br /> staff reports and all public comment and testimony: <br /> Section 1: Findings for Conditional Use Permit Approval <br /> With respect to the approval of the Conditional Use Permit (Case P19-0190), the <br /> Planning Commission makes the following findings as required by Section 18.124.070 <br /> of the Pleasanton Municipal Code: <br /> A. That the proposed location of the conditional use is in accordance with the <br /> objectives of the zoning ordinance and the purpose of the district in which <br /> the site is located. <br /> Some of the objectives of the zoning ordinance are to: foster a harmonious, <br /> convenient, workable relationship among land uses, protect existing land uses <br /> from inharmonious influences and harmful intrusions, and ensure that public and <br /> private lands ultimately are used for the purposes which are most appropriate <br /> and beneficial to the City as a whole. The subject building is located in Bernal <br /> Corporate Park which includes a wide range of uses including professional <br /> offices, light manufacturing and industrial uses, private schools and <br /> does not contain any <br /> operable windows, which will further reduce potential noise impacts on the surrounding area. <br /> Nonetheless, to minimize any potential noise impacts, staff is recommending the following <br /> conditions of approval: <br /> • All exterior doors must remain closed at all times during operating hours; <br /> • Congregants shall not loiter outside of the building and shall be courteous and quiet <br /> when entering or leaving the parking area; and <br /> • The City shall have the right to review the project again to add mitigating conditions <br /> should any future complaints regarding noise levels occur. Such conditions could <br /> include modifying the hours of operation, reducing the number of persons allowed in the <br /> P19-0190 and P19-0191, 7139 Koll Center Parkway Planning Commission <br /> 7 of 9 <br />
