As these locations under state law already may not allow persons under the age of 18 <br />to enter, that limits the policy concerns about exposure of under -age youth. However, <br />these stores are proposed to be treated as "legal non -conforming" uses, therefore <br />cannot physically expand, and cannot re -open if abandoned for more than 90 days. <br />Like the other restrictions discussed, this proposed restriction would go into effect on <br />July 1, 2020; would not apply to wholesalers or distributors; and would exempt products <br />authorized by the FDA for disease treatment. <br />4. Minimum Pack Sizing for Some Cigar and Cigarette Packs. The Youth Commission <br />was advised by speakers at its public meetings that tobacco retailers frequently sell low- <br />cost tobacco products in packs of one, two or three. Such inexpensive items are more <br />accessible to all users, but especially appealing to youth who are experimenting with <br />different tobacco products and are extremely price sensitive. While state law requires <br />cigarettes to be sold in minimum packs of 201, no such regulation applies to little cigars <br />or cigarillos. <br />Products types: <br />A comparison of <br />shapes and sizes <br />CKdNf.101'PPED1 <br />crwww <br />In the area, at least Berkeley, Contra Costa County, and San Pablo have adopted <br />minimum pack sizes for cigars, little cigars and cigarillos.8 <br />The proposed law would impose minimum pack sizes of: cigars - a minimum pack of 6; <br />cigarillos - a minimum pack of 25; and little cigars - a minimum pack of 20. The <br />ordinance does not propose minimum pricing. Attachment 6 would amend Municipal <br />Code Chapter 9.32 to impose this restriction, which would apply to items such as: <br />y, <br />Cigars sold in 5 packs Cigarillos sold in 3 packs Little cigars sold individually <br />' See California Penal Code §308.3. <br />x Again, this is information was obtained during research for tobacco restrictions overall.
