In response to Mayor Thorne's inquiry, Ms. Perko advised the ordinance would require a second <br /> reading by the Council and if adopted, would go into effect thirty days thereafter. She also advised <br /> permits can be issued while the ordinance is in process. In response to Councilmember Pentin's <br /> inquiry, she advised there is a grace period waiving the exam requirement for CAMTC certification <br /> for two (2) years. Chief Spiller advised there are currently 143 CAMTC certified practitioners and <br /> 21 City permitted practitioners. He advised the City permitted practitioners to have the entire <br /> timeline of their permit to seek CAMTC certification. <br /> In response to Councilmember Pentin's inquiry, Ms. Perko advised there is a prohibition on neon <br /> signs from within the business and clarified the prohibition was just for massage businesses. City <br /> Manager Fialho advised that massage businesses could apply for neon signs but there are <br /> certain sign conditions for certain locations. In response to Councilmember Pentin's inquiry, City <br /> Attorney Sodergren advised the insurance requirement is standard for most businesses in <br /> Pleasanton. <br /> In response to Councilmember Narum's inquiry, Ms. Perko advised that CMATC certification <br /> timelines are not clear. Chief Spiller advised that practitioners who are seeking CMATC <br /> certification close to their permit expiration date could have their permit extended while <br /> certification is in process on a case by case basis. <br /> In response to Councilmember Narum's inquiry, Chief Spiller advised the operation requirements <br /> are best practices from CAMTC and other municipalities that regulate massage businesses. Chief <br /> Spiller advised that SB 731 regulated local control and allowed the local municipality to create <br /> specific ordinances to control massage businesses. <br /> Councilmember Testa expressed concern that CAMTC could not give a specific timeline for <br /> certification. In response to Councilmember Testa, Ms. Perko advised the two (2) year <br /> certification fee is $200 and that the Police Department will continue to permit massage <br /> businesses not the individuals. <br /> In response to Councilmember Pentin's inquiry, Chief Spiller advised the application process <br /> which includes a background and live-scan fingerprinting is ultimately issued by the Police Chief. <br /> In response to Councilmember Pentin's inquiry, Chief Spiller clarified the ordinance prohibits neon <br /> signs from within the business to face outside. <br /> In response to Councilmember Brown's inquiry, City Attorney Sodergren advised the operation <br /> standards for neon signs would take place the effective date of the ordinance. <br /> In response to Councilmember Brown's inquiries, Chief Spiller advised that not all convictions <br /> would preclude an applicant from obtaining certification such as conviction of the sale of <br /> marijuana and Ms. Perko advised that acupuncture is regulated by the state and not under the <br /> ordinance; CMATC would look to the City to regulate specific massage techniques. <br /> In response to Councilmember Brown's inquiry, Chief Spiller advised any open signs should be <br /> out by 11:00 p.m. <br /> The public hearing was opened, there being no one wishing to speak the hearing was closed. <br /> Mayor Thorne noted that he knew several massage technicians who served the community well <br /> and expressed concerned the industry has been hijacked by those who engage in human <br /> trafficking.
