Presentation of a proclamation recognizing Muslim Awareness Month <br /> On behalf of the Council, Councilmember Brown presented the proclamation to Spojmie Nasiri, <br /> Calfornia Islamic Relations Council and Munir Safi, Muslim Community Center. <br /> 16. Public Comment <br /> Darsh Goyal, Finn Duggan and Owen Duncan Anderson thanked the City Council for approving a <br /> crossing guard at Vintage Hills. <br /> PUBLIC HEARINGS AND OTHER MATTERS <br /> 17. Consider introduction of an ordinance to amend Chapter 6.24 Massage of the Pleasanton <br /> Municipal Code and repeal Urgency Ordinances 2182 and 2183 Prohibiting the Issuance of <br /> Specified Approvals and Permits for New or Expanded Massage Establishments in the Downtown <br /> Specific Plan Area <br /> Police Chief Dave Spiller presented the staff report and a summary and background of Massage <br /> Establishment and Massage Technician permits which have been regulated in Pleasanton since <br /> 1973. He advised the Police Department and Code Enforcement routinely facilitates code <br /> compliance inspections and enforcement activities according to the Municipal Code. He noted the <br /> Police Department investigates community complaints and reports of unlawful or illicit activities <br /> associated with massage establishments to protect the health and safety of customers and to <br /> curtail illegal activity such as prostitution and human trafficking. <br /> Chief Spiller advised that one of the most significant revisions in the proposed ordinance is the <br /> exclusive certification of massage practitioners through the California Massage Therapy Council <br /> (CAMTC). He reported the Police Department and City Attorney's Office worked collaboratively to <br /> draft the proposed ordinance to addressed changes in State law and concerns surrounding the <br /> massage industry. <br /> Assistant City Attorney Renee Perko reported the most significant change revolves around <br /> permitting by the Police Department for individuals who provide massage. She advised the Police <br /> Department will no longer issue Massage Technician Permit and would need to obtain a CAMTC <br /> certification should they want to continue to work in Pleasanton. She advised there are <br /> approximately twenty practitioners who have the Massage Technician Permit from the Police <br /> Department with the majority of practitioners in Pleasanton already CAMTC certified. <br /> Ms. Perko advised the Police Department will continue to regulate massage businesses through <br /> permitting but will call the permit a City Registration Permit. She highlighted the new operational <br /> requirements which include designating a business administrator to be in charge of the business <br /> when the owner is not on-site, posting a list of services in the reception area, payment for <br /> services, including tip, will only take place it the reception area, names of clients and massage <br /> practitioners, including services provided, amount paid, date and time will be recorded, alcohol <br /> will be prohibited and $2 million general liability/occurrence will be required. <br /> Assistant City Attorney Perko advised the development of the proposed ordinance included <br /> community outreach and meetings with massage practitioners and businesses. On August 20, <br /> 2019, Council adopted the Downtown Specific Plan Update which did not include specific land- <br /> use policies regarding massage in the DSP and Urgency Ordinances 2182 and 2183 are no <br /> longer necessary. She recommended that the City Council introduce an ordinance to amend <br /> Chapter 6.24 of the Municipal Code and repeal Urgency Ordinances 2182 and 2183. <br /> City Council Minutes Page 3 of 5 September 3, 2019 <br />
