Box 520 <br />Pleasanton, CA 94566 <br />Sent by e-mail to: rpatenaude@cityofpleasantonca.gov <br /> <br />Re: Downtown Specific Plan Draft EIR <br /> <br />Dear Mr. Patenaude, <br /> <br />Zone 7 Water Agency (Zone 7, or Zone 7 of the Alameda County Flood Control and Water Conservation District) <br />has reviewed the referenced document in the context of Zone 7’s mission to provide water supply, flood <br />protection, and groundwater and stream management within the Livermore-Amador Valley. Following are our <br />comments for your consideration: <br /> <br />1. Arroyo del Valle <br />x Setback. The plan includes policies to enhance the use of use of, and also to conserve, Arroyo del Valle. <br />Any developments (trails, homes, etc.) adjacent to Arroyo Valle should be subjected to minimum setback <br />requirements as determined by Zone 7 or Alameda County Flood Control and Water Conservation District <br />(ACFCWCD). Zone 7’s minimum requirement is twenty feet from a projected 2.5:1 slope from the bank toe. <br />x Management. On 3.8-2, first paragraph, it states that ACFCWCD is responsible for managing sections of <br />Arroyo Valle within the planning area. This should be revised to read “Arroyo Valle is owned by many <br />entities, including public and private, who all share the responsibility of managing their part of the Arroyo <br />Valle.” <br />x Regulated Stream. On 3.8-7, under Flood Zones, please clarify that the Arroyo del Valle is a regulated <br />stream due to Lake del Valle. A 100-year storm event does not equate to the capacity of Arroyo Valle; Arroyo <br />Valle is subject to Lake del Valle flood releases (made by the Department of Water Resources) which can be <br />greater than runoff from a 100-yr storm event. <br /> <br />2. Section 3.8, Local Regulations <br />Be aware of the following Zone 7 programs and ordinances that may be appropriate to include in the DEIR: <br />x Development Impact Fee. New development and the expansion of existing development may impose a <br />burden on the existing flood protection and storm drainage infrastructure within the Zone 7 service area. <br />Developments creating new impervious areas within the Livermore-Amador Valley are subject to the <br />assessment of the Development Impact Fee for Flood Protection and Storm Water Drainage. These fees are <br />collected for Zone 7 by the local governing agency: 1) upon approval of final map for public improvements
