BACKGROUND <br />On June 3, 2014, City Council approved PUD -101 (Kottinger Gardens), a Planned Unit <br />Development application by MidPen Housing Corporation, Inc. (MidPen) to construct <br />185 senior homes and related site improvements at 240 and 251 Kottinger Drive. Both <br />properties are owned by the City of Pleasanton. <br />The project was constructed in two phases. <br />Phase One <br />Phase One, located at 240 Kottinger Drive, replaced the existing 50 senior homes of <br />Kottinger Place with one 78,010 square -foot, three-story building and nine separate <br />single -story buildings that provide a total of 131 senior homes. <br />The Phase One public improvements that were accepted by the City Council in May <br />2018 included: <br />• Replacement of the existing 16 -inch diameter water main with a new 16 -inch <br />diameter water main and appurtenances located on the 240 Kottinger Drive <br />property and along Kottinger Drive and First Street. <br />• One hundred and ten (110) linear feet of 5 -foot wide concrete sidewalk and two <br />ADA curb ramps along the Kottinger Drive frontage. <br />• One hundred and fifty (150) linear feet of 5 -foot wide concrete sidewalk and two <br />ADA curb ramps along the Vineyard Avenue frontage. <br />One thousand and twelve (1,012) linear feet of concrete pedestrian pathway <br />along the project boundary with Kottinger Park that connects Vineyard Avenue <br />and Kottinger Drive. <br />• Relocation of the existing bus stop along the westbound Kottinger Drive frontage, <br />which included a bus shelter. <br />Phase Two <br />Phase Two, located at 251 Kottinger Drive, replaced the existing 40 senior homes at <br />Pleasanton Gardens, with one 31,600 square -foot, two-story building and four separate <br />single -story buildings that provide a total of 54 senior homes. <br />In October 2017, MidPen entered into a public improvement agreement for the <br />construction of the improvements along the project frontage on Kottinger Drive. The <br />agreement provided for improvement security to ensure the construction of the public <br />improvements. Accordingly, MidPen submitted improvement security in the form of a <br />performance bond and a labor and materials bond in the amounts of $162,500 each. <br />An encroachment permit was issued February 2018 for the construction of the public <br />improvements. <br />DISCUSSION <br />The public improvement agreement provided for the construction of the following: <br />• Two hundred and seventy-six (276) linear feet of curb and gutter <br />• Two hundred and eleven (211) linear feet of sidewalk <br />Page 2 of 3 <br />
