<br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
<br /> PLEASANTON RECOMMENDING THAT THE CITY COUNCIL APPROVE THE
<br /> APPLICATIONS FOR PLANNED UNIT DEVELOPMENT (PUD) REZONING AND
<br /> DEVELOPMENT PLAN LOCATED AT 6455 OWENS DRIVE, AS FILED UNDER
<br /> CASE NOS. P16-1349 (REZONE) AND PUD-121 (DEVELOPMENT PLAN)
<br /> WHEREAS, on July 25, 2016, Abbas Mash ("Applicant") applied for applications
<br /> at 6455 Owens Drive (formerly Denny's) to: (1) demolish the existing approximately
<br /> 3,510-square-foot restaurant building; (2) rezone the subject parcel from C-F (Freeway
<br /> Commercial) District to PUD-C (Planned Unit Development — Commercial) District; and
<br /> (3) construct an approximately 10,980-square-foot, single-story, multi-tenant
<br /> commercial building and related site improvements ("Project"); and
<br /> WHEREAS, the site is designated Retail/Highway/Service Commercial/Business
<br /> and Professional Offices in the General Plan; and
<br /> WHEREAS, on September 28, 2016, the Planning Commission, following public
<br /> notice, conducted a work session, where the Project was presented as a public hearing
<br /> item; and
<br /> WHEREAS, on September 25, 2019, the Planning Commission, following public
<br /> notice, conducted a public hearing where it considered the written agenda report, public
<br /> testimony, related project materials, and staff recommendations; and
<br /> WHEREAS, pursuant to the California Environmental Quality Act (CEQA)
<br /> Guidelines this project is categorically exempt from environmental review pursuant to
<br /> CEQA Guidelines, Section 15332, In-fill Development Projects, Class 32.
<br /> NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City
<br /> of Pleasanton, based on the entire record of proceedings, including the oral and written
<br /> agenda reports and all public comment and testimony:
<br /> Section 1: Findings for PUD-121
<br /> With respect to the PUD Development Plan application, PUD-121, the Planning
<br /> Commission makes the following findings and determinations with respect to each of
<br /> the considerations for approval of a PUD Development Plan as required by Section
<br /> 18.68.110 of the Pleasanton Municipal Code (PMC):
<br /> 1. Whether the plan is in the best interests of the public health, safety, and
<br /> general welfare:
<br /> The Planning Commission finds that the Project is in the best interests of the
<br /> public health, safety, and general welfare for the following reasons:

<br /> 1,000-foot radius of the subject parcel and published in the newspaper. At the time this report
<br /> was published, staff has not received any public comments.

<br />, horizontal belly bands and wainscoting, canvas awnings, wood arbors, and
<br /> various other ornamental treatments comprised of both stucco and metal. Staff believes the
<br /> proposed architecture reflects the high-quality design and materials required for this prominent
<br /> location.
