Resolution No. <br />Page Two <br />influences and harmful intrusions, and ensure that public and private lands ultimately are <br />used for the purposes which are most appropriate and beneficial to the City as a whole. <br />As conditioned, the City Council finds the proposed axe lounge would be consistent with <br />these objectives and would create an appropriate indoor recreation space for the general <br />public. The proposed lounge would be operated so as to not impact or interfere with the <br />surrounding uses in that the number of patrons and hours of operation would not generate <br />substantial noise, parking demand, or traffic. <br />The subject site is zoned PUD -C (Planned Unit Development —Commercial) District, <br />which generally has the characteristics of the City's C -S (Commercial Service) District. <br />The subject shopping center has several multi -tenant buildings with a variety of uses. The <br />proposed use would be complementary and compatible with the existing uses in the <br />shopping center. The proposed activities will be conducted exclusively indoors and on a <br />property with an adequate circulation system and parking supply to support the use. The <br />applicant will also be required to mitigate any future nuisances that may occur as a result <br />of the proposed use. As conditioned, the City Council finds the proposed axe throwing <br />lounge will be consistent with these objectives and zoning district purposes. <br />B. That the proposed location of the conditional use and the conditions under which <br />it would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br />As conditioned, the City Council finds the proposed axe -throwing lounge would make a <br />good neighbor, since all of its proposed activities would occur indoors, would generally <br />peak outside of the operating hours of nearby commercial and office uses, and would <br />include sound -insulated walls to help mitigate any potential noise impacts associated with <br />the use. Indoor recreational uses generally do not subject surrounding uses to heavy truck <br />traffic, hazardous odors, high noise levels, or other objectionable influences. If the <br />recommended conditions of approval are followed, the City Council finds the proposed <br />axe -throwing lounge would not be detrimental to the adjacent/nearby uses or residences. <br />The operation of the project would include adequate measures to ensure the safety of <br />patrons and the general public, including instruction and supervision for the axe -throwing <br />activity, and provisions to ensure the responsible consumption of alcohol by participants. <br />All streets around the subject site are designed per City standards to provide safe ingress <br />and egress into and out of the site. In addition, there is adequate off-street parking <br />available to meet the project's demand. Conditions have also been included that would <br />require the applicant to mitigate any future nuisances as a result of the proposed use. <br />C. That the proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br />The site's zoning conditionally permits the establishment of bowling alleys, pool halls, <br />indoor bocce courts, and other similar uses such as indoor axe -throwing lounges. Granting <br />a CUP for the proposed axe -throwing lounge would be consistent with the City's ability to <br />regulate zoning as listed in Chapter 18.124 of the Municipal Code. In addition, the City <br />Council finds that, as conditioned, the proposed use will comply with all provisions and <br />requirements of the City's zoning ordinance and the approved PUD for Valley Plaza <br />shopping center. <br />Section 2: For the reasons set forth in the staff report and statements made during the public <br />hearing, upholds the decision of the Planning Commission, thereby approving Case P19-0140, <br />
