ATTACHMENT 1 <br />RESOLUTION NO. 19 - <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON UPHOLDING <br />THE PLANNING COMMISSION APPROVAL OF A CONDITIONAL USE PERMIT FOR <br />MICHAEL HILL ON BEHALF OF THE LIMITLESS AXE LOUNGE LOCATED AT 1809 <br />SANTA RITA ROAD, SUITES A AND B, AS FILED UNDER CASE NO. P19-0140 <br />WHEREAS, on May 29, 2019, Michael Hill, on behalf of Limitless Axe Lounge, applied for <br />Conditional Use Permit approval to operate an indoor axe -throwing lounge located at 1809 Santa <br />Rita Road, Suites A and B; and <br />WHEREAS, zoning for the property is PUD -C (Planned Unit Development -Commercial) <br />District; and <br />WHEREAS, the project is categorically exempt from the California Environmental Quality <br />Act (CEQA) pursuant to Section 15301, (Existing Facilities), since the project would not result in <br />the expansion of the exterior or the building and/or would be limited to interior alternations of the <br />existing building. Therefore, no additional environmental review is required; and <br />WHEREAS, at its meeting on August 14, 2019, the Planning Commission held aduly- <br />noticed public hearing, and having considered relevant exhibits, recommendations of the City staff <br />concerning this application, and received testimony from the applicant and interested parties, <br />approved the application, subject to conditions of approval; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the City Council <br />requested that the application and approval of the Planning Commission be reviewed by the City <br />Council; and <br />WHEREAS, on September 17, 2019, the City Council held a duly noticed public hearing <br />on this application and considered all public testimony, agenda reports, and related materials, <br />and the Planning Commission approval; and <br />WHEREAS, after a review of the materials presented, the City Council determines that <br />the proposed Conditional Use Permit application is consistent with the City's General Plan and <br />purposes of the Pleasanton Municipal Code, and adopts and reaffirms all of the considerations <br />and findings set forth in Planning Commission Resolution. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />Section 1: Findings for Conditional Use Permit Approval <br />With respect to the approval of P19-0140, the City Council reaffirms the following findings as <br />required by Section 18.124.070 of the Pleasanton Municipal Code: <br />A. That the proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which the site <br />is located. <br />Some of the objectives of the zoning ordinance are to: foster a harmonious, convenient, <br />workable relationship among land uses, protect existing land uses from inharmonious <br />
