THE CITY OF -�� °°�� :��ir'`°' CITY COUNCIL AGENDA REPORT �L£�S�4NTON, September 17, 2019 Community Development Planning Division TITLE: REVIEW OF THE PLANNING COMMISSION'S APPROVAL OF A CONDITIONAL USE PERMIT APPLICATION TO OPERATE AN INDOOR AXE -THROWING LOUNGE LOCATED AT 1809 SANTA RITA ROAD, SUITES A & B SUMMARY Under consideration is whether a conditional use permit (CUP) should be granted to allow an indoor axe -throwing lounge within an existing tenant space at 1809 Santa Rita Road, Suites A & B, within the Valley Plaza shopping center. While axe -throwing lounges are not specifically listed in the Pleasanton Municipal Code (PMC), staff suggests the use could be classified in the "bowling alleys, pool halls, indoor bocce courts, and other similar uses" category of the PMC, which, at this location, requires approval of a CUP. The Planning Commission approved the CUP on August 14, 2019 subject to conditions of approval. Pursuant to PMC Section 18.144.010 City Council Review, on August 20, 2019, the Council majority voted to call the action of the Planning Commission up for review. Accordingly, the application is before the City Council, who may confirm the Planning Commission's approval without changes, modify the approval (e.g., by modifying or adding conditions), or overturn the Planning Commission's decision (i.e., deny the CUP). PLANNING COMMISSION ACTION On August 14, 2019, the Planning Commission, on a 4-1 vote (Commissioner Allen dissenting), approved the subject application based on the project analysis and CUP considerations, and subject to nineteen Conditions of Approval. The Planning Commission's findings and conditions of approval are included in the Planning Commission Resolution of approval (Attachment 2). The Planning Commission agenda report and excerpted minutes are included as Attachments 3 and 4. RECOMMENDATION Adopt the draft resolution upholding the Planning Commission's approval of Case No. P19-0140, subject to the Conditions of Approval in Exhibit A of Attachment 1. FISCAL IMPACT No fiscal impacts to the City or public services are anticipated.
