Planning Manager Clark clarified that the Active Ground Floor Overlay item should be extended to side <br />streets and whether some exemptions should be applied to bank buildings. <br />MOTION: It was m/s by Thorne/Pentin to approve the Active Ground Floor Overlay item within the <br />DSP. Motion passed unanimously. Testa recused. <br />Planning Manager Clark clarified that the original decision was to not allow Ground -floor residential <br />uses on properties with a Main Street frontage or within the Mixed-use Downtown area. <br />MOTION: Mayor Thorne moved to approve the Ground -floor residential use item within the DSP, <br />seconded by Councilmember Pentin. Motion passed unanimously. Testa recused. <br />Planning Manager Clark clarified the original decision on the Barone's property was to allow for <br />rezoning to mixed-use transitional" for the redevelopment of that site. She further advised the original <br />First Street property decision was to approve a residential overlay subject to a PUD. In response to <br />Mayor Thorne's inquiry, Acting Director of Community Development Dolan advised that the Barone's <br />property would need to maintain a commercial front to retain the residential overlay. <br />In response to Councilmember Pentin's inquiry, Planning Manager Clark clarified the First Street <br />property would be subject to the Downtown Commercial zoning standard which allows for up to 40 feet <br />and two -stories encouraged and three -stories allowed on a case-by-case basis. <br />In response to Councilmember Pentin's inquiry, City Manager Fialho clarified that if the First Street <br />property went to residential only, it would be limited to two -stories. <br />MOTION: It was m/s by Thorne/Pentin to approve the Barone property -owner -initiated request. Motion <br />passed by with Brown voting no and Testa recused. <br />Councilmember Brown expressed concern regarding the height of the building with subterranean <br />parking. Acting Director of Community Development Dolan advised that with a PUD, City Council can <br />give staff direction to consider a third story on the First Street property. <br />MOTION: It was m/s by Pentin/Narum to approve the First Street property -owner -initiated request. <br />Motion passed with Brown voting no and Testa recused. <br />Planning Manager Clark recapped the Development standards and the maximum height for each Land <br />Use District. In response to Councilmember Brown's inquiry, Planning Manager Clark advised that a <br />four-story project could not be supported with current language. <br />In response to Councilmember Pentin's inquiry regarding items such as radio towers and flagpoles, <br />Planning Manager Clark advised this is a clarification of existing Municipal Code language to allow for <br />such items and architectural features. Councilmember Pentin supports the recommendation that <br />nothing over three -stories gets approved. Councilmember Brown recommends that staff define the term <br />"story." Councilmember Brown suggests that any PUD requesting three-story properties be reviewed by <br />Council. <br />MOTION: It was m/s by Narum/Pentin to approve the Development Standard item. Motion passed <br />unanimously. Testa recused. <br />Councilmember Narum recommended adding language to the DSP at the PDA's request to say the city <br />considers downtown business that follow the rules are not a nuisance. <br />MOTION: It was m/s by Narum/Pentin to approve a right to do business ordinance with the additional <br />language.
