<br /> The applicant is hereby notified, as part of this approval, that (s)he is required to satisfy and maintain
<br /> compliance with the conditions of approval below. Where approval by the Director of Community
<br /> Development, Planning Division, Director of Engineering/City Engineer, City Attorney, Chief Building and
<br /> Safety Official, Fire Department or other City staff is required, review shall be for compliance with all
<br /> applicable conditions of approval, adopted policies and guidelines, ordinances. laws and regulations, and
<br /> accepted practices related to the approval. In addition to complying with the conditions below, the
<br /> applicant is required to comply with all applicable federal, state, and local laws that pertain to this project
<br /> whether or not specifically noted herein.
<br /> This approval is granted for: 1) rezoning the site from the C-N (Neighborhood Commercial) District to the
<br /> PUD-C (Planning Unit Development — Commercial) District; 2) Planned Unit Development (PUD)
<br /> Development Plan to demolish the existing 7-Eleven convenience store, auto service/smog check
<br /> building, and Shell service station canopy and construct an approximately 3,034-square-foot 7-Eleven
<br /> convenience store. 1,290 square-foot drive-through carwash building, 3,311-square-foot Shell self-
<br /> service station canopy, and related site improvements; and 3) Conditional Use Permit (CUP) for the
<br /> operation of a fuel station, a convenience store, and a drive-through carwash located on Assessor
<br /> Parcel Nos. (941 130903403 and 941 130903500) at 3760 and 3790 Hopyard Road. Development shall
<br /> be substantially as shown on the project materials listed below:
<br /> a. Project plans, Exhibit B, prepared by PM Design Groups, Inc. for Anabi Real Estate
<br /> Development, LLC. dated "Received" on August 7, 2019, and kept on file in the Planning Division
<br /> of the Community Development Department.
<br /> b. Color and materials board prepared by PM Design Groups, Inc. for Anabi Real Estate
<br /> Development, LLC, dated August 7, 2019, and kept on file in the Planning Division of the
<br /> Community Development Department.
<br /> c. Arborist Report, prepared by HortScience/Bartlett Consulting, dated May 2019
<br /> d. Car Wash Noise Assessment, prepared by Illingworth & Rodkin, Inc., dated June 11, 2019
<br /> e. Shell Fuel Station — Health Risk Assessment, prepared by Illingworth & Rodkin, Inc., dated March
<br /> 5, 2019
<br /> The project materials listed above are collectively the "Approved Plans".
<br /> THIS APPROVAL IS GRANTED SUBJECT TO THE FOLLOWING CONDITIONS:
<br /> 1. APPROVAL AND REVISIONS: The proposed development shall be in substantial conformance
<br /> with the "Approved Plans", except as modified by the following conditions. Minor changes to the
<br /> plans may be allowed subject to the approval of the Director of Community Development if found
<br /> to be in substantial conformance with the approved exhibits. Planning Division approval is
<br />n the noise assessment prepared
<br /> by Illingworth & Rodkin, Inc. including the proposed carwash dryers and vacuum
<br /> units utilizing quieter systems to ensure compliance with the City's Noise
<br /> Ordinance. Conditions of approval will ensure the subject use will not be operated
<br /> in a manner that is detrimental to the public health, safety, or welfare or be
<br />onservatively analyzes impacts to workers and visitors to the
<br /> church.
