As such, the applicant also requests the <br /> approval of a CUP in order to accommodate the proposed uses. <br /> The proposed PUD rezoning and development plan applications are subject to review and <br /> approval by the City Council, following review and recommendation by the Planning <br /> Commission. The Planning Commission normally reviews and takes final action on Conditional <br /> Use Permit applications. However, since the subject Conditional Use Permit is an integral part <br /> of the PUD application, staff recommends that the Council also take final action on the <br /> Conditional Use Permit application. <br /> April 10, 2019, Planning Commission Work Session <br /> In order to receive early feedback from the Planning Commission and any interested <br /> individuals regarding the proposed project, a Planning Commission work session was held on <br /> April 10, 2019. <br /> Representatives of the Church of Pleasanton, who own the adjoining property to the south, <br /> attended the work session and spoke on the subject applications. Since the filing of the <br /> application, representatives of the church have contacted staff indicating concerns related to <br /> the operation of the existing convenience store. Specifically, the church's representatives <br /> indicated that convenience store patrons loiter and leave trash in the church parking lot, and <br /> delivery trucks and customers use the church's property for unloading and parking. The <br /> church's representative stated similar concerns at the work session. In response, the applicant <br /> suggested the proposed removal of the existing internal drive aisle between the church and <br /> convenience store properties would help to address the church's concerns. In addition, after <br /> the work session, the applicant installed signs on the convenience store site informing store <br /> patrons to not park on the church site. <br /> After taking public testimony, the Planning Commission provided the following comments on <br /> the work session discussion points (additional comments made by the Commission are in the <br /> attached minutes — Exhibit C): <br /> Discussion Point No. 1: <br /> Would it be appropriate to rezone the site from the current C-N District to a PUD-C District in <br /> order to allow a 24-hour convenience market with the sale of alcoholic beverages and a drive- <br /> through carwash in conjunction with the existing gas station? <br /> Commissioners unanimously supported the proposed rezoning and uses. <br /> Discussion Point No. 2: <br /> Should the proposed triangular-shaped building be revised to a rectangular-shaped building <br /> oriented perpendicular to Hopyard Road, and to eliminate the loading space? <br /> The Commission unanimously concurred that the proposed shape and orientation of the <br /> convenience store building were acceptable and supported the loading space. <br /> Discussion Point No. 3: <br /> Are the proposed site plan, circulation, and parking acceptable? <br /> PUD-134/P18-0332/P18-0334 Planning Commission <br /> Page 3 of 24 <br /> a <br /> convenience market that would include the sale of alcoholic beverages, the applicant requests <br /> the current zoning of the site be changed in order to allow the proposed project. <br /> The proposed Planned Unit Development-Commercial (PUD-C) zoning would require a <br /> Conditional Use Permit (CUP) for the service station with convenience market with the sale of <br /> PUD-134/P18-0332/P18-0334 Planning Commission <br /> Page 2 of 24 <br />
