Item 3—Recommendation on Adoption of Downtown Specific Plan and Related Amendments <br /> • Right-to-do-Business Ordinance: Use other methods (i.e., project conditions of <br /> approval) to address potential conflicts between downtown residential and <br /> commercial uses. <br /> Additional Recommendation(s) <br /> In light of the significant amount of City Council and public comments and concern <br /> around this topic; staff recommends a further provision be included in the DSP, to make <br /> any project in the Downtown Commercial and Mixed Use-Transitional Districts that <br /> includes residential uses, subject to approval of a Planned Unit Development (PUD) <br /> plan. And, it is recommended that a clarification be made to require a PUD <br /> development plan (or similar legislative approval, such as a Master Development Plan) <br /> to be approved prior to development of any project within the Mixed-Use Downtown <br /> District (existing Civic Center and adjacent City-owned (former SFPUC) parcel) that <br /> would represent a change in use from those existing today. <br /> This approach allows for additional review and scrutiny of such project, including <br /> aspects such as configuration and amount of commercial space, site plan and parking, <br /> and off-site visual impacts for new residential uses. And, for the Civic Center site, <br /> makes it clear that Planning Commission and City Council approval will be required (in <br /> addition to voter approval) before any redevelopment of this area can proceed. <br /> Policy Topic 4: Property-Owner Initiated Requests <br /> During the course of the DSP update, two separate property-owners (i.e., owners of <br /> 4212 First Street and 475/493 St. John Street), expressed interest in residential <br /> development on their lots. The properties currently have commercial land use <br /> designations. At the February 26 meeting the Task Force supported an approach <br /> suggested by staff, to reflect the interest and potential for residential uses at 4212 First <br /> Street and 475/493 St. John Street by placing a residential "overlay" or annotation on <br /> the DSP land use map. The overlay would clearly allow for consideration of either <br /> standalone residential uses, commercial uses, or a combination of both, but would <br /> require processing of a Planned Unit Development (PUD) application, so that the <br /> legislative (re-zoning) change would require review and approval by Planning <br /> Commission and City Council. <br /> April 16/May 8 City Council Direction <br /> The City Council considered the two properties separately and provided direction on <br /> each as follows: <br /> • 4212 First Street: Retain the existing Downtown Commercial land use <br /> designation, with a map annotation to note potential for a future residential-only <br /> project, subject to approval of a PUD rezoning/PUD Plan. A workshop will be <br /> required prior to a formal application. <br /> • 475/493 St. John Street: Retain the existing Downtown Commercial land use <br /> designation, with a map annotation to note potential for a future Mixed Use- <br /> Transitional designation to be applied to the property, subject to approval of a <br /> PUD rezoning/PUD Plan.
