BACKGROUND On April 18, 2017, the City Council approved a Professional Services Agreement with FirstCarbon Solutions (FCS) for services for the preparation of a subsequent Environment Impact Report (SEIR) for Tim Lewis Communities' (TLC) proposal of 39 single-family detached homes and related improvements on the Spotorno site in an amount not to exceed $252,370 which included in a contingency of $22,949. A copy of the signed agreement is attached. During the course of preparing the Draft SEIR, Additional analysis for several topics including traffic, air quality and noise was determined to be necessary, and authorizations for expenditure of the contingency were provided by staff as allowed by the contract. DISCUSSION During the public review period of the draft SEIR, a significant number of comments were received requiring additional time to be spent to prepare responses for inclusion in the Final SEIR. In addition, the City and TLC have engaged in discussions about modifications to the project to include the construction of a pedestrian trail or path along Alisal Street between Westbridge Lane and Sycamore Road. This component was not included in the Draft SEIR, and so additional study, including field investigation, is needed to ensure it is properly incorporated and analyzed in the EIR. With the additional work, FCS requested an amendment to the existing contract in the amount of $22,479, for a new contract amount of $274,849. The requested scope and budget amendment from FCS is attached. Staff has reviewed the proposed augment with the applicant who has accepted the proposal and submitted additional funds to cover the proposed costs.
