THE CITY OF 4 5 ;iil;i �.• li:iii ..1•.I111� '=i pLEASANTON_ CITY COUNCIL AGENDA REPORT June 4, 2019 Community Development Planning Division TITLE: APPROVAL OF FIRST AMENDMENT TO A PROFESSIONAL SERVICES AGREEMENT WITH FIRSTCARBON SOLUTIONS (FCS) FOR $22,479, FOR CEQA REVIEW OF THE PROPOSED SPOTORNO RANCH PROJECT BY TIM LEWIS COMMUNITIES, FOR A NEW TOTAL CONTRACT AMOUNT OF $274,849. SUMMARY On April 18, 2017, the City Council authorized the City Manager to enter into a Professional Services Agreement with FirstCarbon Solutions (FCS) for services for the preparation of a Subsequent Environment Impact Report (SEIR) for Tim Lewis Communities' (TLC) proposed development of 39 single-family detached homes and related improvements on the Spotorno site. The agreement was for an amount not to exceed $252,370, which included in a contingency of $22,949. During the course of project review the need arose for additional traffic, air quality and noise impact analysis that was not included in the original scope of work. Authorizations were given to complete these tasks from the contingency. Since release of the Draft SEIR, Tim Lewis Communities has engaged with the City to discuss potential revisions to the project, including the construction of a trail or pedestrian path along Alisal Street; since this component was not analyzed in the Draft SEIR, additional field review and analysis is needed to ensure it is properly reflected in the CEQA document. Staff is requesting approval of an amendment to the Professional Services Agreement in the amount of an additional $22,479 for the field investigation. RECOMMENDATION Authorize the City Manager to execute the first amendment to the Professional Services Agreement with FCS to add $22,479 to the original amount of $252,370 (for a total of $274,849) for services related to the preparation of the Final SEIR for TLC's proposal on the Spotorno site. FINANCIAL STATEMENT TLC will cover all of the $22,479 contract amendment. As such, there is no financial impact on the City's part associated with this action.
